Kira s\u00f6zle\u015fmelerinde pek \u00e7ok madde ve kural yer almaktad\u0131r. Bunlara kira art\u0131\u015f bedelleri de dahildir. Bu nedenle <strong>kira kontrat\u0131nda art\u0131\u015f maddesi yoksa ne olur <\/strong>sorusuyla s\u0131k s\u0131k kar\u015f\u0131la\u015f\u0131lmaktad\u0131r. Kira s\u00f6zle\u015fmesinde yer almayan eksik h\u00fck\u00fcmler nedeniyle zaman zaman ev sahipleriyle kirac\u0131lar aras\u0131nda anla\u015fmazl\u0131k \u00e7\u0131kabilmektedir. Kira art\u0131\u015f da bunlar aras\u0131nda yer almaktad\u0131r.<\/p>\n\n\n\n<p>T\u00fcrkiye\u2019de enflasyon oran\u0131 olduk\u00e7a y\u00fcksektir. Bu nedenle <strong>kira art\u0131\u015f\u0131 <\/strong>oranlar\u0131n\u0131n belirlenmemesi ya da tespit edilmemesi gibi durumlar ya\u015fanmamaktad\u0131r. Kira s\u00f6zle\u015fmeleri yaz\u0131l\u0131rken kiraya veren taraf bazen y\u00fcksek kira art\u0131\u015f oranlar\u0131 talep edebilirler. Ama ev sahiplerinin kira art\u0131\u015f oran\u0131 yazmay\u0131 unutmalar\u0131 ay da belirsiz oranlar yazmalar\u0131 nedeniyle kira art\u0131\u015f durumuna ili\u015fkin belirsizlikler olu\u015fabilmektedir.<\/p>\n\n\n\n<p>Kanunlar taraf\u0131ndan belirlenen maddelere g\u00f6re taraflar aras\u0131 anla\u015fma olmad\u0131\u011f\u0131 m\u00fcddet\u00e7e yeni kira d\u00f6neminde uygulanacak art\u0131\u015f hakim taraf\u0131ndan kiralanan evin durumu de\u011ferlendirilerek bir \u00f6nceki kira y\u0131l\u0131ndaki \u00fcretici fiyat endeksi g\u00f6z \u00f6n\u00fcne al\u0131narak ger\u00e7ekle\u015ftirilmektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">T\u00dcFE Oran\u0131<\/h2>\n\n\n\n<p><strong>T\u00dcFE oran\u0131 <\/strong>yap\u0131lacak olan kira art\u0131\u015f oranlar\u0131 i\u00e7in son derece \u00f6nemlidir. \u00c7\u00fcnk\u00fc t\u00fcketici ve \u00fcretici fiyat endeksleri enflasyon oran\u0131na g\u00f6re de\u011fi\u015fiklik g\u00f6stermektedir. \u00d6rnek vermek gerekirse T\u00dcFE ayl\u0131k art\u0131\u015f oran\u0131n\u0131 30,80 olarak vermi\u015f, ancak s\u00f6zle\u015fmedeki kira art\u0131\u015f bedeli 35.90\u2019a denk geliyorsa o art\u0131\u015f yasal olarak ge\u00e7ersiz say\u0131lmaktad\u0131r. Ev sahipleri belirlenen orandan daha fazla art\u0131\u015f yapamazlar.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/mulktakibi.com\/blog\/wp-content\/uploads\/2026\/05\/Kira-Kontratinda-Artis-Maddesi-Yoksa-Ne-Olur2-1024x683.jpeg\" alt=\"\" class=\"wp-image-744\" srcset=\"https:\/\/mulktakibi.com\/blog\/wp-content\/uploads\/2026\/05\/Kira-Kontratinda-Artis-Maddesi-Yoksa-Ne-Olur2-1024x683.jpeg 1024w, https:\/\/mulktakibi.com\/blog\/wp-content\/uploads\/2026\/05\/Kira-Kontratinda-Artis-Maddesi-Yoksa-Ne-Olur2-300x200.jpeg 300w, https:\/\/mulktakibi.com\/blog\/wp-content\/uploads\/2026\/05\/Kira-Kontratinda-Artis-Maddesi-Yoksa-Ne-Olur2-768x512.jpeg 768w, https:\/\/mulktakibi.com\/blog\/wp-content\/uploads\/2026\/05\/Kira-Kontratinda-Artis-Maddesi-Yoksa-Ne-Olur2.jpeg 1536w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p><strong>TBK 344 <\/strong>maddesinde belirtilenlere g\u00f6re iki taraf aras\u0131nda yap\u0131lan bir anla\u015fma olmad\u0131\u011f\u0131 durumlarda yenilenen kira d\u00f6neminde uygulanacak olan kira bedeli hakimce kiralanan konutun durumuna bak\u0131larak, bir \u00f6nceki kira y\u0131l\u0131ndaki \u00fcretici fiyat endeksine g\u00f6re art\u0131\u015f yap\u0131lmaktad\u0131r.<\/p>\n\n\n\n<p>Bu durumda kira s\u00f6zle\u015fmesinin sona ermesiyle yeni kira d\u00f6neminde uygulanacak olan kira bedeline dair bir d\u00fczenleme yer alm\u0131yorsa iki taraf bir tutar \u00fczerinden anla\u015fma sa\u011flayam\u0131yorsa yenilenen kira d\u00f6nemindeki bedel T\u00fcrk Bor\u00e7lar Kanunu madde 344\u2019e g\u00f6re hakim taraf\u0131ndan belirlenir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Yasal Kira Art\u0131\u015f\u0131<\/h2>\n\n\n\n<p><strong>Yasal kira art\u0131\u015f\u0131 <\/strong>oranlar\u0131 d\u00fczenli olarak T\u00dcFE sitesinde ve resmi gazetelerde a\u00e7\u0131klanmaktad\u0131r. Bu oranlar\u0131n \u00fczerinde yap\u0131lmak istenen art\u0131\u015flar yasal kira art\u0131\u015flar\u0131 kapsam\u0131na girmemekte ve ge\u00e7erli olmamaktad\u0131r. E\u011fer ev sahibi, T\u00dcFE taraf\u0131ndan belirlenen kira art\u0131\u015f oran\u0131ndan daha fazla art\u0131\u015f yapmak istiyorsa bu yasal bir durum de\u011fildir. Kirac\u0131lar haklar\u0131n\u0131 arayabilmektedirler.<\/p>\n\n\n\n<p>E\u011fer yap\u0131lan kira s\u00f6zle\u015fmesinde kira art\u0131\u015f oran\u0131 T\u00dcFE\u2019nin belirledi\u011fi oran\u0131 a\u015f\u0131yorsa bu durumda yine s\u00f6zle\u015fmede yazan art\u0131\u015f yasal say\u0131lmamaktad\u0131r. Hem ev sahiplerinin enflasyon nedeniyle ma\u011fdur olmamas\u0131 hem de kirac\u0131lar\u0131n ev sahiplerinin haks\u0131z zam taleplerine kar\u015f\u0131 \u00f6nlem al\u0131nmas\u0131 i\u00e7in yasalara g\u00f6re hareket edilmelidir.<\/p>\n\n\n\n<p>Bazen baz\u0131 ev sahipleri, ekonomik zorluklar\u0131 ve enflasyonlar\u0131 gerek\u00e7e g\u00f6stererek kirac\u0131lardan \u00e7ok daha fazla kira isteyebilmektedirler. Bu durumun giderek artmas\u0131 nedeniyle yasalar bak\u0131m\u0131ndan \u00f6nlem al\u0131nm\u0131\u015ft\u0131r. Ev sahipleri kirac\u0131lardan haks\u0131z derecede y\u00fcksek mebla\u011flar talep edemez. Bunun yan\u0131 s\u0131ra kirac\u0131lar belirlenen oranlarda yap\u0131lan zamlara uymak durumundad\u0131r.<\/p>\n\n\n\n<p><strong>S\u00f6zle\u015fmede art\u0131\u015f olmamas\u0131 <\/strong>durumunda TBK 344 uygulanmaktad\u0131r. Evin mevcut durumu, konumu ve de\u011feri gibi durumlar hesaba kat\u0131larak uygulanacak olan zam oran\u0131 hakim taraf\u0131ndan belirlenmektedir. Kira art\u0131\u015flar\u0131yla ilgili maddeler s\u00f6zle\u015fmede yer almazsa ve kiraya zam yap\u0131lmak istenirse yasal s\u00fcre\u00e7lerle u\u011fra\u015fmak gerekebilir. Bu nedenle mutlaka kira s\u00f6zle\u015fmesi yaparken \u201cnas\u0131l olsa konu\u015fulup \u00e7\u00f6z\u00fcl\u00fcr\u201d denilmemeli, her t\u00fcrl\u00fc duruma uygun s\u00f6zle\u015fme maddelerine ve kanun maddelerine yer verilmelidir.
