Bu nedenler s\u00f6zle\u015fmede yer almakta ve ev sahibinin haklar\u0131n\u0131 korumak i\u00e7in d\u00fczenlenmektedir. <strong>E<\/strong><strong>v sahibi kirac\u0131y\u0131 ka\u00e7 kez uyarabilir <\/strong>sorusu, kirac\u0131lar i\u00e7in \u00f6nemli bir sorudur. Ev sahipleri \u00e7e\u015fitli nedenlerden dolay\u0131 kirac\u0131lara ihtarname g\u00f6nderebilmektedirler ve bu ihtarnameler genelde noter ile g\u00f6nderilir.<\/p>\n\n\n\n<p>Kira s\u00f6zle\u015fmelerinde kirac\u0131lar\u0131n esas y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc kira bedelini tam olarak ve zaman\u0131nda \u00f6demektir. Kirac\u0131lar kira bedellerini tam olarak \u00f6dese bile bunu zaman\u0131nda yapm\u0131yor, geciktiriyorsa ev sahibi kira s\u00f6zle\u015fmesini feshedebilmektedir. Bundan \u00f6nce <strong>ihtarname <\/strong>g\u00f6ndererek kirac\u0131y\u0131 uyarmal\u0131d\u0131r. Kirac\u0131n\u0131n kiras\u0131n\u0131 eksiksiz ve zaman\u0131nda \u00f6demesi \u00f6nem ta\u015f\u0131r.<\/p>\n\n\n\n<p>Kira \u00f6demesi bir g\u00fcn bile gecikirse ev sahipleri kirac\u0131lara ihtarname g\u00f6nderme hakk\u0131na sahiptir. T\u00fcrk Bor\u00e7lar Kanunu madde 352\u2019ye g\u00f6re tahliye davas\u0131 a\u00e7abilmektedir. Hakl\u0131 ihtar nedeniyle kirac\u0131n\u0131n tahliye edilmesi i\u00e7in tahliye davas\u0131 a\u00e7\u0131labilmekte ve ev sahibi kirac\u0131y\u0131 evden \u00e7\u0131karabilmektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Tahliye S\u00fcreci<\/h2>\n\n\n\n<p><strong>Tahliye s\u00fcreci <\/strong>an\u0131nda ger\u00e7ekle\u015fen bir durum de\u011fildir ve zaman gerektirir. \u0130ki hakl\u0131 ihtar sebebiyle tahliye davas\u0131 a\u00e7\u0131labilmekte, ancak bu dava i\u00e7in baz\u0131 \u015fartlar\u0131n olu\u015fmas\u0131 gerekmektedir. \u00d6ncelikle ev sahibi kirac\u0131y\u0131 iki farkl\u0131 zamanda iki farkl\u0131 ihtarla uyarm\u0131\u015f olmal\u0131d\u0131r. \u0130htar nedenleri ise \u015funlard\u0131r:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0130ki taraf aras\u0131nda ger\u00e7ekle\u015fen kira s\u00f6zle\u015fmesi i\u015f yeri ya da konut \u00fczerine olmal\u0131d\u0131r. Araba ya da e\u015fya kiralama gibi durumlar i\u00e7in ge\u00e7erli de\u011fildir.<\/li>\n\n\n\n<li>Kirac\u0131, kira bedelini zaman\u0131nda \u00f6dememi\u015f olmal\u0131, geciktirmelidir.<\/li>\n\n\n\n<li>Ev sahibi kira \u00f6demesinin verilen s\u00fcre i\u00e7inde \u00f6denmemesi nedeniyle kirac\u0131ya bir kira y\u0131l\u0131 i\u00e7inde farkl\u0131 aylarda <strong>kirac\u0131 uyar\u0131 <\/strong>niteli\u011fi ta\u015f\u0131yan iki yaz\u0131l\u0131 ihtarname g\u00f6ndermi\u015f olmal\u0131d\u0131r.<\/li>\n\n\n\n<li>\u0130ki hakl\u0131 ihtar nedeniyle tahliye davas\u0131 kira s\u00fcresinden bir y\u0131l fazlaysa kirac\u0131ya ihtar g\u00f6nderilen kira y\u0131l\u0131n\u0131n bitiminden itibaren bir ayl\u0131k s\u00fcrede a\u00e7\u0131lmal\u0131d\u0131r. Kiraya veren ki\u015fi kirac\u0131ya g\u00f6nderilen ihtar\u0131n hakl\u0131 ihtar olmas\u0131 i\u00e7in \u015fu durumlara sahip olmas\u0131 gerekir:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0130htarlar kirac\u0131ya yaz\u0131l\u0131 olarak g\u00f6nderilmelidir.<\/li>\n\n\n\n<li>G\u00f6nderilen ihtar\u0131n ispatlanmas\u0131 i\u00e7in noter arac\u0131l\u0131\u011f\u0131yla g\u00f6nderilmelidir.<\/li>\n\n\n\n<li>Vadesi gelen kira bedeli miktar\u0131, kiran\u0131n hangi aya ait oldu\u011fu ve geciken kiran\u0131n \u00f6denmesi talebi bu ihtarnamelerde yer almal\u0131d\u0131r.<\/li>\n\n\n\n<li>Kira s\u00fcresi bir y\u0131ldan fazlaysa son kira y\u0131l\u0131 i\u00e7inde geciken kira \u00f6demeleri de ihtarda belirtilmelidir.<\/li>\n\n\n\n<li>\u0130htar, usule uygun olacak \u015fekilde kirac\u0131lara g\u00f6nderilmi\u015f olmal\u0131d\u0131r.<\/li>\n\n\n\n<li>Kirac\u0131ya g\u00f6nderilen ihtarlar tek bir aya de\u011fil, farkl\u0131 kira aylar\u0131na ait olmal\u0131d\u0131r.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Bildirim Hakk\u0131<\/h2>\n\n\n\n<p>Kiran\u0131n gecikmesi, kira s\u00f6zle\u015fmesine ayk\u0131r\u0131 davran\u0131lmas\u0131 ve kirac\u0131n\u0131n eve zarar vermesi halinde ev sahiplerinin <strong>bildirim hakk\u0131 <\/strong>her zaman vard\u0131r. Bu bildirimler olas\u0131 tahliye davalar\u0131 durumunda daha kolay ispatlanabilmeleri i\u00e7in yaz\u0131l\u0131 bir \u015fekilde noterlikler arac\u0131l\u0131\u011f\u0131yla kirac\u0131lara g\u00f6nderilmelidir.<\/p>\n\n\n\n<p><strong>Kira ihlali <\/strong>ya\u015fand\u0131\u011f\u0131 zaman ev sahipleri bir kira y\u0131l\u0131 i\u00e7inde farkl\u0131 aylarda iki kere kirac\u0131lara ihtarname g\u00f6nderebilmektedir. E\u011fer g\u00f6nderilen ihtarnamelere ra\u011fmen bir de\u011fi\u015fiklik olmuyorsa bu durumda ev sahipleri Sulh Hukuk Mahkemeleri\u2019ne giderek dava a\u00e7abilirler.<\/p>\n\n\n\n<p>Bu davalarda yetkili mahkemeler:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Daval\u0131 kirac\u0131n\u0131n yerle\u015fim yerindeki mahkeme<\/li>\n\n\n\n<li>Kiralanan ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer<\/li>\n\n\n\n<li>Davac\u0131 kiraya verenin yerle\u015fim yeri<\/li>\n<\/ul>\n\n\n\n<p>\u0130ki hakl\u0131 ihtar davas\u0131 kira s\u00fcresinin sonunda ya da kira s\u00fcresi bir y\u0131ldan uzunsa a\u00e7\u0131labilmektedir. Bu davalarda dava a\u00e7ma masraflar\u0131 y\u0131ll\u0131k kira bedeline oranla de\u011fi\u015fim g\u00f6stermektedir.
