Evden \u00e7\u0131kma karar\u0131 kirac\u0131lar iin zorlu bir s\u00fcre\u00e7 olabilmektedir. Kirac\u0131n\u0131n tahliye edilebilmesi i\u00e7in kanunda yer alan nedenlerin varl\u0131\u011f\u0131 \u015fart\u0131 aranmaktad\u0131r. Bildirim s\u00fcreleri ev sahiplerinin hangi nedenden dolay\u0131 kirac\u0131y\u0131 \u00e7\u0131karmak istedi\u011fine g\u00f6re farkl\u0131l\u0131k g\u00f6stermektedir. Kirac\u0131 belirlenen tarihte evden ayr\u0131lmazsa ev sahipleri bu tarihten itibaren 1 ay i\u00e7inde kirac\u0131n\u0131n evden \u00e7\u0131kar\u0131lmas\u0131 ad\u0131na tahliye davas\u0131 a\u00e7abilmektedir. Kirac\u0131lar yaln\u0131zca T\u00fcrk Bor\u00e7lar Kanunu\u2019nda yer alan kira bedelinin \u00f6denmemesi, s\u00f6zle\u015fme bitimi, tadilat ve ihtiya\u00e7 gibi nedenlerden dolay\u0131 tahliye edilebilmektedir.<\/p>\n\n\n\n<p>\u0130htiya\u00e7 nedeniyle tahliye s\u00fcrecinde belirsiz s\u00fcreli s\u00f6zle\u015fmelerde her 6 ayda bir en az 3 ay \u00f6ncesinde kirac\u0131lara yaz\u0131l\u0131 bildiri g\u00f6nderilmelidir. Kirac\u0131 evden \u00e7\u0131kmazsa ev sahipleri 1 ay i\u00e7inde tahliye davas\u0131 a\u00e7mal\u0131d\u0131r. Belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00f6zle\u015fmenin bitiminden itibaren 1 ay i\u00e7inde tahliye davas\u0131 a\u00e7\u0131lmal\u0131d\u0131r.<\/p>\n\n\n\n<p>Kira bedelinin \u00f6denmemesi durumda ise durum farkl\u0131 olsa da ayn\u0131 yollar\u0131 i\u00e7ermektedir. Kirac\u0131 ayn\u0131 kira y\u0131l\u0131 i\u00e7inde iki defa kira bedelini \u00f6dememi\u015fse ev sahipleri 1 ay i\u00e7inde dava a\u00e7ma hakk\u0131na sahiptir. Kira bedelinin kesinlikle \u00f6denmemesi veya anla\u015fmaya var\u0131lamamas\u0131 durumunda 30 g\u00fcn i\u00e7inde noter arac\u0131l\u0131\u011f\u0131yla ihtar g\u00f6nderilmelidir. Belirlenen s\u00fcrede \u00f6deme yap\u0131lmazsa icra yoluyla tahliye i\u015flemleri ba\u015flat\u0131lmal\u0131d\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kira S\u00f6zle\u015fmesi Feshi<\/h2>\n\n\n\n<p><strong>Kira s\u00f6zle\u015fmesi feshi <\/strong>durumunda kirac\u0131lar s\u00f6zle\u015fmenin biti\u015f tarihinde evden ayr\u0131lm\u0131\u015f olmal\u0131d\u0131r. Bu nedenle kira s\u00f6zle\u015fmesinin s\u00fcresinin bitimine uygun olacak \u015fekilde ta\u015f\u0131nma i\u015flemlerini ba\u015flatmalar\u0131 gerekir. Kira s\u00f6zle\u015fmesinin sonunda, s\u00f6zle\u015fme kendili\u011finden sora ermemekte, belirli s\u00fcreli yap\u0131lm\u0131\u015f olsa bile kira s\u00fcresinin sona ermesi nedeniyle s\u00f6zle\u015fme bitmemektedir. E\u011fer s\u00f6zle\u015fme biti\u015f tarihine kadar iki taraf da sessiz kal\u0131rsa s\u00f6zle\u015fme otomatik olarak kendini 1 y\u0131l daha ayn\u0131 \u015fartlarla yenilemektedir. Bu 10 sene boyunca devam edebilir.
