Sitelerin ve apartmanlar\u0131n i\u015fletilebilmesi ve devaml\u0131l\u0131\u011f\u0131 i\u00e7in y\u00f6netim kurulu ya da apartman y\u00f6neticisi taraf\u0131ndan belli miktar aidat toplan\u0131r. Aidatlar her ay d\u00fczenli olarak \u00f6denmelidir. Kat M\u00fclkiyeti Kanunu\u2019nda yer alan ta\u015f\u0131nmazlara emredici kanun h\u00fck\u00fcmleri sakl\u0131 kalacak \u015fekilde y\u00f6netim aksi bir \u015fey kararla\u015ft\u0131rmad\u0131k\u00e7a t\u00fcm apartman sakinleri ortak gideri kar\u015f\u0131lamakla y\u00fck\u00fcml\u00fc olur.<\/p>\n\n\n\n<p><strong>Kirac\u0131 aidat \u00f6demezse <\/strong>apartman ya da sitenin i\u015fleyi\u015fi aksayabilir. \u00d6rne\u011fin g\u00fcvenlik g\u00f6revlisinin, kap\u0131c\u0131n\u0131n ve di\u011fer \u00e7al\u0131\u015fanlar\u0131n maa\u015flar\u0131 \u00f6denmeyebilir. Bu nedenle mutlaka aidat \u00f6denmelidir. Ayr\u0131ca Kat M\u00fclkiyeti Kanunu madde 22\u2019ye g\u00f6re aidat borcunu \u00f6demekle sorumlu olan as\u0131l taraf kat malikleridir. Bu madde kapsam\u0131nda kirac\u0131lar da aidat borcuyla y\u00fck\u00fcml\u00fcd\u00fcr. Fakat kanun maddesinin devam\u0131nda, kirac\u0131n\u0131n aidat borcundan sorumlu olmaktan \u00e7ok kira borcundan sorumludur. Aidat borcunu \u00f6demedi\u011fi ayda kirac\u0131 olan taraf kiraya veren ev sahibine kira borcunu \u00f6demi\u015fse art\u0131k y\u00f6neticiler aidat\u0131 kirac\u0131dan talep edemez.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Aidat Borcu Kirac\u0131 Sorumlulu\u011fu<\/h2>\n\n\n\n<p><strong>Aidat borcu kirac\u0131 sorumlulu\u011fu <\/strong>olmaktan \u00e7ok ev sahibinin sorumlulu\u011fudur. Aidat \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcyle alakal\u0131 bir di\u011fer durum, kirac\u0131 ile ev sahibi aras\u0131nda yap\u0131lan kira s\u00f6zle\u015fmesinde yer alan maddelerdir. Kira s\u00f6zle\u015fmesinde genelde kiralanan eve ait aidat \u00f6demesinin kirac\u0131 taraf\u0131nda yap\u0131laca\u011f\u0131 yaz\u0131l\u0131r. Kira s\u00f6zle\u015fmesiyle aidat \u00f6demelerinin kimin sorumlulu\u011funda olaca\u011f\u0131 ya da aidattan kirac\u0131n\u0131n sorumlu oldu\u011funa dair s\u00f6zle\u015fme maddelerin ge\u00e7erlili\u011fi 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu\u2019nda d\u00fczenlenmi\u015ftir.<\/p>\n\n\n\n<p>T\u00fcrk Bor\u00e7lar Kanunu madde 303\u2019e g\u00f6re kiralanan ev ya da i\u015fyerinin kullan\u0131m\u0131yla ilgili olacak \u015fekilde yap\u0131lan giderler kiraya veren tarafa aittir. <strong>A<\/strong><strong>partman aidat\u0131 \u00f6demezse <\/strong>y\u00f6netim taraf\u0131ndan ev sahibinden talep edilmektedir.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/mulktakibi.com\/blog\/wp-content\/uploads\/2026\/04\/Kiraci-Aidat-Borcunu-Odemezse-Ne-Olur2-1024x683.jpeg\" alt=\"\" class=\"wp-image-705\" srcset=\"https:\/\/mulktakibi.com\/blog\/wp-content\/uploads\/2026\/04\/Kiraci-Aidat-Borcunu-Odemezse-Ne-Olur2-1024x683.jpeg 1024w, https:\/\/mulktakibi.com\/blog\/wp-content\/uploads\/2026\/04\/Kiraci-Aidat-Borcunu-Odemezse-Ne-Olur2-300x200.jpeg 300w, https:\/\/mulktakibi.com\/blog\/wp-content\/uploads\/2026\/04\/Kiraci-Aidat-Borcunu-Odemezse-Ne-Olur2-768x512.jpeg 768w, https:\/\/mulktakibi.com\/blog\/wp-content\/uploads\/2026\/04\/Kiraci-Aidat-Borcunu-Odemezse-Ne-Olur2.jpeg 1536w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>T\u00fcrk Bor\u00e7lar Kanunu madde 341\u2019de konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralamalar\u0131nda iki taraf aksi bir durum i\u00e7in anla\u015fmad\u0131\u011f\u0131 m\u00fcddet\u00e7e su, do\u011falgaz ve elektrik gibi evin kullan\u0131m\u0131na ili\u015fkin giderleri \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc kirac\u0131lara aittir.<\/p>\n\n\n\n<p>Konut ya da i\u015fyeri kiralar\u0131nda iki taraftan biri aksini s\u00f6ylemedi\u011fi s\u00fcrece aidat\u0131 k\u0131rac\u0131lar \u00f6der. Kirac\u0131 olan taraf aidat \u00f6demelerini d\u00fczenli ve tam yapmazsa bu durumda ev sahibi TBK madde 315\u2019e g\u00f6re kirac\u0131ya en az 30 g\u00fcn s\u00fcre verir. Bu s\u00fcreden sonra ev sahibi kirac\u0131n\u0131n evden tahliyesi i\u00e7in tahliye davas\u0131 a\u00e7abilmektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Site Aidat Borcu<\/h2>\n\n\n\n<p><strong>Site aidat borcu <\/strong>\u00f6denmedi\u011fi zaman apartman\u0131n ya da sitenin i\u015fleyi\u015finde aksakl\u0131klar meydana gelebilir. \u00d6denmeyen aidat borcu nedeniyle kirac\u0131 tahliye davas\u0131 a\u00e7mak ad\u0131na site ya da apartman y\u00f6netimine aidat borlar\u0131n\u0131n ilk \u00f6nce ev sahibi taraf\u0131ndan \u00f6denmesi gerekmektedir.<\/p>\n\n\n\n<p><strong>Aidat borcu yasal i\u015flem <\/strong>ba\u015flat\u0131lmas\u0131na neden olan durumlar aras\u0131ndad\u0131r. Kirac\u0131 ya da kiraya veren taraf mutlaka d\u00fczenli olarak aidat\u0131 \u00f6demelidir. Aksi durumda hem ev sahibi hem de kirac\u0131 yasal i\u015flemlerle kar\u015f\u0131la\u015fabilir.<\/p>\n\n\n\n<p>Kiralanan ta\u015f\u0131nmaz\u0131n demirba\u015f\u0131na ili\u015fkin aidat ya da ortak gider \u00fccretlerinin toplanmas\u0131 durumunda bu giderlerden mal sahibi sorumlu tutulmaktad\u0131r. Kirac\u0131lar ta\u015f\u0131nmas\u0131n demirba\u015flar\u0131na ili\u015fkin \u00fccret \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bulunmamaktad\u0131r. Bu nedenle kirac\u0131ya kar\u015f\u0131 icra takibi ya da dava a\u00e7madan \u00f6nce aidat borcu \u00f6denmelidir.<\/p>\n\n\n\n<p>Yarg\u0131tay 8. Hukuk Dairesinin ald\u0131\u011f\u0131 kararda dava konusu somut olay\u0131n apartman aidat\u0131 alaca\u011f\u0131na ili\u015fkin oldu\u011fu ve site aidat\u0131n\u0131n kiralanan evin kullan\u0131m\u0131na ait yan gider oldu\u011funa h\u00fckmedilmi\u015ftir. Fakat site aidat\u0131 s\u00f6zle\u015fmede aksi belirtilmedik\u00e7e site y\u00f6netimine \u00f6denmesi gereken bor\u00e7 kapsam\u0131nda de\u011ferlendirilir. Kirac\u0131dan istenebilir ve ev sahibinin aidat borcunu site y\u00f6netimine mutlaka \u00f6demesi gerekir.
