Kira s\u00f6zle\u015fmelerinde art\u0131\u015f\u0131n \u00fcst s\u0131n\u0131r\u0131 daima T\u00fcketici Fiyat Endeksi taraf\u0131ndan belirlenmektedir. Bu oranlar y\u0131ll\u0131k enflasyon g\u00f6z \u00f6n\u00fcne al\u0131narak belirlenir. Bu oran\u0131n \u00fczerinde kira art\u0131\u015f\u0131 yap\u0131lamamakta ancak bu oran\u0131n alt\u0131nda kira art\u0131\u015f\u0131 yap\u0131labilmektedir. E\u011fer ev sahibi istemezse hi\u00e7 art\u0131\u015f yapmayabilir.<\/p>\n\n\n\n<p><strong>Kira s\u00f6zle\u015fmesi feshi <\/strong>tek tarafl\u0131 ger\u00e7ekle\u015ftirilmek isteniyorsa bu durum mutlaka hakl\u0131 sebeplere dayanmal\u0131d\u0131r. E\u011fer iki taraf da s\u00f6zle\u015fmenin feshini isterse bu durumda i\u015fler daha da kolayla\u015f\u0131r. Yasal kira art\u0131\u015flar\u0131 kira s\u00f6zle\u015fmelerinde belirlenen kira art\u0131\u015fl\u0131d\u0131r ve iki taraf da bu kira art\u0131\u015f\u0131na uymakla y\u00fck\u00fcml\u00fcd\u00fcr. Ancak bu tamamen serbest olmak de\u011fildir. Taraflar\u0131n yenilenen kira d\u00f6neminde uygulanacak kira belenine dair anla\u015fmalar\u0131 bir \u00f6nceki kira y\u0131l\u0131ndaki on iki ayl\u0131k oranun ortalamas\u0131na g\u00f6re de\u011fi\u015fmektedir. T\u00dcFE her y\u0131l bu oranlar\u0131 a\u00e7\u0131klamakta ve art\u0131\u015flar buna g\u00f6re ger\u00e7ekle\u015fmektedir.<\/p>\n\n\n\n<p>Kira art\u0131\u015f\u0131na uymayan kirac\u0131lar\u0131n tahliye edilmesi talep edilebilmektedir. Kiraya veren taraf bu yasal hakka sahiptir. Bu durumda kiraya veren taraf icra takibi sayesinde s\u00f6zle\u015fmeye uygun kira fark\u0131n\u0131 talep edebilmektedir. Ayr\u0131ca bunun haricinde tahliye davas\u0131 a\u00e7arak eksik \u00f6denen kira belleri ad\u0131na kirac\u0131n\u0131n evden \u00e7\u0131kmas\u0131n\u0131 sa\u011flayabilirler. Bu s\u00fcre\u00e7lerin sonunda ise kiraya veren taraf hem eksik \u00f6demesini geri alabilirken hem de kira art\u0131\u015f\u0131na uymayan kirac\u0131lar\u0131 evden hukuksal yollarla \u00e7\u0131karabilirler.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kira S\u00f6zle\u015fmesi \u0130ptali<\/h2>\n\n\n\n<p><strong>Kira s\u00f6zle\u015fmesi iptali <\/strong>pek \u00e7ok nedenden dolay\u0131 ger\u00e7ekle\u015febilir. Ev sahipleri kirac\u0131lar\u0131 evden \u00e7\u0131karmak istiyorsa bunu kiran\u0131n ge\u00e7 \u00f6denmesi ya da kira s\u00f6zle\u015fmesine ayk\u0131r\u0131l\u0131k gibi ge\u00e7erli nedenlere dayand\u0131rmal\u0131d\u0131r. Kiraya s\u00f6zle\u015fmesine ayk\u0131r\u0131 durumlardan baz\u0131lar\u0131 \u015f\u00f6yle s\u0131ralanabilir:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Kirac\u0131n\u0131n kiray\u0131 eksik \u00f6demesi ya da zaman\u0131nda \u00f6dememesi<\/li>\n\n\n\n<li>Kirac\u0131n\u0131n evin yap\u0131s\u0131na zarar verecek eylemlerde bulunmas\u0131<\/li>\n\n\n\n<li>Kirac\u0131n\u0131n sorumlulu\u011funda olan aidat\u0131n \u00f6denmemesi<\/li>\n<\/ul>\n\n\n\n<p>Ayr\u0131ca ev sahibi, kiraya verdi\u011fi evi kendisi ya da ailesi i\u00e7in kullanmak ad\u0131na kirac\u0131y\u0131 evden \u00e7\u0131kararak s\u00f6zle\u015fmeyi feshedebilir. Ev sahipleri, kiraya verdikleri evi kendileri i\u00e7in kullanmak istiyorlarsa bunu mahkemeye deliller e\u015fli\u011finde sunmal\u0131d\u0131r. Evi kullanma ihtiyac\u0131 \u015fu durumlarda ge\u00e7erlidir:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ev sahibi evi kendisi ya da e\u015fi i\u00e7in kullanmak istiyorsa<\/li>\n\n\n\n<li>Altsoyu (\u00e7ocuk, torun vb) i\u00e7in kullanmak istiyorsa<\/li>\n\n\n\n<li>\u00dcstsoy (anne, baba, b\u00fcy\u00fckanne vb) i\u00e7in kullanmak istiyorsa<\/li>\n\n\n\n<li>Yasal olarak bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu ki\u015fi ya da ki\u015filerin kullan\u0131m\u0131na a\u00e7acaksa<\/li>\n<\/ul>\n\n\n\n<p>Bu nedenleri gerek\u00e7e g\u00f6stererek evin tahliye edilmesi sa\u011flanmaktad\u0131r. Ancak i\u015flemler hukuksal s\u00fcre\u00e7lere uyarak ilerler.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kira S\u00f6zle\u015fmesi Sona Erdirme<\/h2>\n\n\n\n<p><strong>Kira s\u00f6zle\u015fmesi sona erdirme <\/strong>s\u00fcrecinde dikkat edilmesi gereken pek \u00e7ok nokta vard\u0131r. E\u011fer kira s\u00f6zle\u015fmesinin sona etmesi s\u00f6z konusuysa ev sahipleri kirac\u0131lara ihtarname g\u00f6ndermelidir. Bu s\u00fcre i\u00e7inde kirac\u0131lar yeni bir yere ta\u015f\u0131nmak i\u00e7in i\u015flemlerini tamamlayabilir. Ancak s\u00f6zle\u015fmeye ayk\u0131r\u0131 durumlar nedeniyle s\u00f6zle\u015fme sona erdirilecekse bu durumda farkl\u0131 i\u015flemler uygulan\u0131r.<\/p>\n\n\n\n<p><strong>Ev sahibi s\u00f6zle\u015fme fesih hakk\u0131 <\/strong>e\u011fer kirac\u0131lar s\u00f6zle\u015fmeyi ihlal eden davran\u0131\u015flarda bulunuyorsa ortaya \u00e7\u0131kar. Ev sahipleri s\u00f6zle\u015fmeye ayk\u0131r\u0131 durumlara ili\u015fkin deliller e\u015fli\u011finde ta\u015f\u0131nmaz\u0131n yer ald\u0131\u011f\u0131 b\u00f6lgedeki mahkemeye ba\u015fvururlar. Mahkemenin yo\u011funluk durumuna g\u00f6re evin tahliye s\u00fcreci de uzay\u0131p k\u0131salabilmektedir.<\/p>\n\n\n\n<p>Ev sahipleri mutlaka delillerle birlikte mahkemeye ba\u015fvurmal\u0131d\u0131r. Ba\u015fvuru dilek\u00e7esi de usule uygun haz\u0131rlanmal\u0131d\u0131r. Aksi durumda mahkeme talebi reddedebilir. Do\u011fru \u015fekilde mahkemeye ba\u015fvurabilmek i\u00e7in ev sahipleri kendi haklar\u0131ndan haberdar olmal\u0131d\u0131r.
