Ev sahipleri istedikleri zaman nedensiz \u015fekilde kirac\u0131lar\u0131 evden \u00e7\u0131karamaz. Hakl\u0131 nedenleri olsa dahi s\u00fcre\u00e7 farkl\u0131 i\u015flemektedir.<\/p>\n\n\n\n<p><strong>Kirac\u0131 mahkeme olmadan \u00e7\u0131kar\u0131labilir mi <\/strong>sorusu \u00f6zellikle kirac\u0131lar\u0131n merak etti\u011fi bir konudur. Ev sahipleri kira kontrat\u0131 olmad\u0131\u011f\u0131 durumlarda kirac\u0131y\u0131 bu nedenden dolay\u0131 evden \u00e7\u0131karamaz. T\u00fcrk Bor\u00e7lar Kanunu\u2019nda yer alan yasalara g\u00f6re bir tahliye nedeni varsa s\u00f6zle\u015fmeli ya da s\u00f6zle\u015fmesiz kirac\u0131 o \u015fekilde tahliye edilmektedir.<\/p>\n\n\n\n<p><strong>Mahkemesiz tahliye m\u00fcmk\u00fcn m\u00fc <\/strong>sorusunun cevab\u0131 iki taraf da anla\u015fm\u0131\u015fsa hay\u0131rd\u0131r. Ancak anla\u015fmazl\u0131k sonucu tahliye isteniyorsa bu durumda mahkemeye ba\u015fvurulur. Kirac\u0131 tahliye davas\u0131 s\u00fcreci farkl\u0131 durumlara ba\u011fl\u0131 olarak de\u011fi\u015fiklik g\u00f6sterebilmektedir. Davan\u0131n a\u00e7\u0131ld\u0131\u011f\u0131 mahkeme ve mahkemenin i\u015f y\u00fck\u00fc, s\u00fcrecin i\u015flemesi konusunda \u00f6nemli bir yere sahiptir. Ayr\u0131ca taraflar\u0131n sundu\u011fu deliller de s\u00fcrecin ne kadar uzayaca\u011f\u0131n\u0131 belirlemektedir. Bu d\u00fcre genellikle birka\u00e7 hafta ile ay aras\u0131nda de\u011fi\u015fmektedir. Duru\u015fma zaman\u0131nda mahkemece beyanlar dinlenir ve kan\u0131tlar g\u00f6zden ge\u00e7irilir. Ek s\u00fcre talep edilmesi durumunda dava s\u00fcresi uzar.<\/p>\n\n\n\n<p>Kirac\u0131 evden \u00e7\u0131kmak istemiyorsa mahkeme karar\u0131 kesinle\u015fene kadar kiralad\u0131klar\u0131 evde durabilirler. Kirac\u0131lar\u0131n oturduklar\u0131 b\u00f6lgedeki yerel yasalar da s\u00fcrece etki etmektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ev Sahibi Kirac\u0131 \u00c7\u0131karma<\/h2>\n\n\n\n<p><strong>Ev sahibi kirac\u0131 \u00e7\u0131karma <\/strong>s\u00fcrecinde her istedi\u011fini yapamaz. \u00d6rne\u011fin kirac\u0131lar evden \u00e7\u0131kmadan izinsiz eve giremez, kilidi de\u011fi\u015ftiremez, abonelikleri iptal edemez ya da kirac\u0131lar\u0131n konutu kullanma hakk\u0131n\u0131 k\u0131s\u0131tlayamaz. Kirac\u0131lar\u0131n korunmas\u0131na dair s\u0131k\u0131 yasalar yer almaktad\u0131r. Bu durumda tahliye i\u015flemleri de uzayabilmektedir.<\/p>\n\n\n\n<p>Kira hukuku tahliye s\u00fcrecinde iki taraf\u0131n da tutumu \u00e7ok \u00f6nemlidir. Yasalar hem kirac\u0131y\u0131 hem ev sahibini g\u00fcvence alt\u0131na alsa da kirac\u0131 tahliye s\u00fcrecinde ev sahipleri kafalar\u0131na g\u00f6re hareket edemezler. Kirac\u0131lar kira s\u00f6zle\u015fmesiyle birlikte evi kullanma hakk\u0131na sahip olurlar ve bu s\u00fcre boyunca haks\u0131z yere \u00e7\u0131kar\u0131lamazlar.<\/p>\n\n\n\n<p>Kirac\u0131 tahliyesi, kira s\u00f6zle\u015fmesinin sona ermesi ya da kanunda yer alan nedenlerin var olmas\u0131 durumunda kirac\u0131n\u0131n kiralanan evden \u00e7\u0131kmas\u0131 anlam\u0131na gelir. Kirac\u0131lar s\u00f6zle\u015fmeye ayk\u0131r\u0131 davran\u0131yorsa, kiray\u0131 zaman\u0131nda ya da tam \u00f6demiyorsa ve eve zarar veriyorsa ev sahiplerinin tahliye davas\u0131 a\u00e7ma hakk\u0131 vard\u0131r.<\/p>\n\n\n\n<p>Ayr\u0131ca ev sahipleri evi kendilerinin ya da ba\u015fkas\u0131n\u0131n kullan\u0131m\u0131 i\u00e7in bo\u015faltmak isteyebilir.
