Yeni ev sahipleri, kirac\u0131lar\u0131 \u00e7\u0131karabilir. Ancak bunun i\u00e7in baz\u0131 \u015fartlar\u0131n olu\u015fmu\u015f olmas\u0131 gerekmektedir. T\u00fcrk Bor\u00e7lar Kanunu madde 351\u2019de yer alanlara g\u00f6re yeni ev sahipleri kirac\u0131lar\u0131 \u00e7\u0131karabilse de bunu hukuki \u00e7er\u00e7eve i\u00e7erisinde yapmal\u0131d\u0131r.<\/p>\n\n\n\n<p><strong>Yeni malik kirac\u0131y\u0131 \u00e7\u0131karabilir mi <\/strong>gibi sorular eski kirac\u0131lar ve yeni ev sahipleri aras\u0131nda anla\u015fmazl\u0131klara yol a\u00e7abilmektedir. Yeni ev al\u0131nm\u0131\u015fsa ve kirac\u0131 evden \u00e7\u0131km\u0131yorsa yeni ev sahipleri tapu tescilinden itibaren 1 ay i\u00e7inde kirac\u0131ya yaz\u0131l\u0131 bir bildirimde bulunmal\u0131d\u0131r. Evi alma tarihinden 6 ay sonra da kirac\u0131n\u0131n evden \u00e7\u0131kar\u0131lmas\u0131 i\u00e7in tahliye davas\u0131 a\u00e7abilmektedir.<\/p>\n\n\n\n<p><strong>Ev sat\u0131n al\u0131nca kirac\u0131 durumu <\/strong>yasalarla korunma alt\u0131ndad\u0131r. Yeni ev sahipleri kirac\u0131lar\u0131 hemen \u00e7\u0131karamaz ya da izinsiz bir \u015fekilde eve giremez. Yeni ev sahiplerine kirac\u0131y\u0131 tahliye imkan\u0131 sa\u011flayan T\u00fcrk Bor\u00e7lar Kanunu madde 351\u2019e g\u00f6re kirac\u0131l\u0131 ev alan ki\u015fi o evi kendisi i\u00e7in kullanabilir. Ayr\u0131ca e\u015fi, \u00fcstsoyu, altsoyu ya da kanunen bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu ki\u015filerin kullan\u0131m\u0131 i\u00e7in tahliye etmek isteyebilir. Bunu mahkemeye kan\u0131tlayarak bir ay i\u00e7inde durumu kirac\u0131ya yaz\u0131l\u0131 olarak ihtarname \u015feklinde g\u00f6nderir. Bu ihtarnamelerin noter arac\u0131l\u0131\u011f\u0131yla yap\u0131lmas\u0131 \u00f6nemlidir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kirac\u0131l\u0131 Ev Sat\u0131n Alma<\/h2>\n\n\n\n<p><strong>Kirac\u0131l\u0131 ev sat\u0131n alma <\/strong>konusunda insanlar biraz \u00e7ekingen davranabilmektedir. Bunun nedeni, ya\u015fanabilecek anla\u015fmazl\u0131klardan do\u011facak dava s\u00fcre\u00e7leridir. Kanunlar kirac\u0131lar\u0131n haklar\u0131n\u0131 korudu\u011fu gibi ev sahiplerinin haklar\u0131n\u0131 da korumaktad\u0131r. TBK madde 351\u2019de yer alan bir di\u011fer h\u00fckme g\u00f6re yeni ev sahibi gereksinim nedeniyle s\u00f6zle\u015fmeyi sona erdirme hakk\u0131na sahiptir. Ev sat\u0131n al\u0131nd\u0131ktan sonraki s\u00fcre\u00e7lere ve ad\u0131mlara uyularak kirac\u0131lar\u0131n tahliyesi talep edilebilir. Ayr\u0131ca e\u011fer kirac\u0131larla anla\u015f\u0131l\u0131rsa dava s\u00fcrecine gerek kalmadan da kirac\u0131lar evden tahliye edilebilmektedir. T\u00fcrk Bor\u00e7lar Kanunu\u2019nda belirtilen ad\u0131mlara uyularak evden \u00e7\u0131kmak istemeyen kirac\u0131lar i\u00e7in tahliye davas\u0131 a\u00e7\u0131labilmektedir. Bu dava hakl\u0131 nedenlere dayan\u0131larak ve kan\u0131tlarla a\u00e7\u0131lmal\u0131d\u0131r. Bu nedenle ihtarname de noter arac\u0131l\u0131\u011f\u0131yla g\u00f6nderilerek kan\u0131t olu\u015fturulabilir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Konut \u0130htiyac\u0131 Nedeniyle Tahliye<\/h2>\n\n\n\n<p><strong>Konut ihtiyac\u0131 nedeniyle tahliye <\/strong>davalar\u0131 baz\u0131 \u015fartlara dayanmaktad\u0131r. Yeni ev sahibi ya da kanunda verilen yak\u0131nlar\u0131n\u0131n ev ihtiyac\u0131 olmas\u0131 durumunda evi sat\u0131n ald\u0131ktan sonraki 1 ay i\u00e7inde kirac\u0131ya yaz\u0131l\u0131 ihtarname g\u00f6ndermelidir. Sat\u0131n al\u0131nman\u0131n ger\u00e7ekle\u015fti\u011fi andan itibaren 6 ay sonra tahliye davas\u0131 a\u00e7\u0131l\u0131r. Bir di\u011fer yol ise kira s\u00f6zle\u015fmesinin dona ermesini beklemek ve bu tarihten sonraki 1 ay i\u00e7inde tahliye davas\u0131 a\u00e7makt\u0131r.<\/p>\n\n\n\n<p>Bu \u015fartlardan ilki, yeni ev sahibinin konut ihtiyac\u0131d\u0131r. Ancak ihtiya\u00e7 kavram\u0131 farkl\u0131 yorumlanmaya a\u00e7\u0131kt\u0131r. Bu nedenle samimi bir ihtiyac\u0131n varl\u0131\u011f\u0131 \u015fartt\u0131r. Bu ihtiya\u00e7 mahkemeye kan\u0131tlanmal\u0131d\u0131r. T\u00fcrk Bor\u00e7lar Kanunu madde 351\u2019e g\u00f6re, ihtiya\u00e7 i\u00e7in kirac\u0131n\u0131n evden \u00e7\u0131kar\u0131labilece\u011fine a\u00e7\u0131k\u00e7a yer verilmektedir. Kullan\u0131m ihtiyac\u0131 kapsam\u0131na giren durumlar \u015funlard\u0131r:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Yeni ev sahibi ya da e\u015fi<\/li>\n\n\n\n<li>Yeni ev sahibin altsoyu ya da \u00fcstsoyu<\/li>\n\n\n\n<li>Yeni ev sahibinin kanunlar do\u011frultusunda bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu ki\u015fi ya da ki\u015filer<\/li>\n<\/ul>\n\n\n\n<p>Altsoy \u00e7ocuk, torun ve onlar\u0131n torunlar\u0131n\u0131 temsil ederken \u00fcstsoy anne, baba ve onlar\u0131n anne babas\u0131n\u0131 temsil etmektedir. Yansoya dahil olan ki\u015filer bu kapsama dahil de\u011fildir.<\/p>\n\n\n\n<p><strong>Kirac\u0131 tahliye s\u00fcresi <\/strong>sunulan delillere ve \u015fartlara ba\u011fl\u0131 olarak de\u011fi\u015fim g\u00f6sterebilir.
