Kirac\u0131lar\u0131n kira \u00f6dememesi, s\u00f6zle\u015fmeye ayk\u0131r\u0131 davranmas\u0131 ya da evi tahliye etmesi gibi durumlarda g\u00f6nderilmektedir.<\/p>\n\n\n\n<p>\u0130htarnameler kirac\u0131 ve ev sahibi aras\u0131ndaki kar\u015f\u0131l\u0131kl\u0131 edinimlerin ifas\u0131n\u0131n gecikmesi, eksik kira \u00f6demesi ya da mal teslimi gibi durumlarda bunlar\u0131n yerine getirilmesi i\u00e7in kullan\u0131lan y\u00f6ntemlerdir. Alacakl\u0131 olan taraf alaca\u011f\u0131 mal ya da paran\u0131n muhatab\u0131 olan bor\u00e7lu taraftan, mahkemeye ba\u015fvurmadan \u00f6nce ihtarname \u00e7ekerek talepte bulunabilmektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kirac\u0131ya \u0130htarname Neden G\u00f6nderilir<\/h2>\n\n\n\n<p><strong>Kirac\u0131ya ihtarname neden g\u00f6nderilir <\/strong>ve nas\u0131l g\u00f6nderilir gibi sorular, her kirac\u0131 ve ev sahibi aras\u0131nda ya\u015fanabilecek problemlerin mahkemeye ta\u015f\u0131nmamas\u0131 i\u00e7in \u00f6nemlidir. \u0130htarnamede bulunmas\u0131 gereken unsurlar Noterlik Kanunu\u2019nda yer alan madde 106\u2019da belirtilmi\u015ftir. Bunlar:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u0130htar ve ihbar konusu<\/li>\n\n\n\n<li>\u0130steyen ve isteyen taraf\u0131n ad, soyad\u0131 ve a\u00e7\u0131k adresi<\/li>\n\n\n\n<li>Tebli\u011f \u015fehri, m\u00fch\u00fcr, tarih ve noter imzas\u0131<\/li>\n\n\n\n<li>\u0130stemde bulunan ki\u015finin imzas\u0131<\/li>\n<\/ul>\n\n\n\n<p><strong>Kira hukuku ihtarname <\/strong>ile sorunlar\u0131 ortadan kald\u0131rmak i\u00e7in \u00f6nemlidir. Kanunda belirtilen bir di\u011fer duruma g\u00f6re ihtarnameler ilgili ki\u015fi taraf\u0131ndan yaz\u0131l\u0131r ve tebli\u011f i\u00e7in notere g\u00f6t\u00fcr\u00fcr. Bu durumda noter taraf\u0131ndan g\u00f6nderilmesi daha iyidir. \u00c7\u00fcnk\u00fc noter taraf\u0131ndan g\u00f6nderilen ihtarnameler, sonras\u0131nda anla\u015fmazl\u0131k mahkemeye ta\u015f\u0131n\u0131rsa kan\u0131t niteli\u011fi ta\u015f\u0131yabilir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kirac\u0131ya \u0130htar \u00c7ekme \u015eartlar\u0131<\/h2>\n\n\n\n<p><strong>Kirac\u0131ya ihtarname \u00e7ekme \u015fartlar\u0131 <\/strong>dikkatle incelenmeli ve uygulanmal\u0131d\u0131r. S\u00f6zle\u015fmeye ayk\u0131r\u0131 davranan kirac\u0131lar i\u00e7in ev sahipleri ya da ev sahiplerinin avukat\u0131 taraf\u0131ndan haz\u0131rlanmaktad\u0131rlar. Ayr\u0131ca noter taraf\u0131ndan da haz\u0131rlanabilirler. \u015eartlara uygun olarak 3 n\u00fcsha \u015feklinde ihtarnameler haz\u0131rlan\u0131r. Bu n\u00fcshalardan biri noterce kirac\u0131ya tebli\u011f edilir. Di\u011feri ev sahibinde kal\u0131rken son n\u00fcsha ise noterde kal\u0131r.<\/p>\n\n\n\n<p><strong>Kirac\u0131ya ihtar s\u00fcreci <\/strong>bu ad\u0131mlarla ba\u015flar. Kirac\u0131ya ihtarnameler \u015fu durumlarda g\u00f6nderilir:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Kiran\u0131n eksik \u00f6denmesi ya da hi\u00e7 \u00f6denmemesi<\/li>\n\n\n\n<li>Ev sahibinin kiraya verilen eve ihtiya\u00e7 duymas\u0131 sonucu kirac\u0131y\u0131 tahliye etmek istemesi<\/li>\n\n\n\n<li>Eve kar\u015f\u0131 kirac\u0131 taraf\u0131nda zarar verilmesi<\/li>\n\n\n\n<li>Kira s\u00f6zle\u015fmesinin 10 seneyi doldurmas\u0131<\/li>\n\n\n\n<li>Etraf\u0131 rahats\u0131z eden eylemler<\/li>\n\n\n\n<li>S\u00f6zle\u015fmeye ayk\u0131r\u0131 tutumlar.<\/li>\n<\/ul>\n\n\n\n<p>Ayr\u0131ca T\u00fcrk Bor\u00e7lar Kanunu madde 350\u2019ye g\u00f6re gereksinim ya da yeniden in\u015fa nedeniyle kirac\u0131n\u0131n evden \u00e7\u0131kar\u0131lmas\u0131na ili\u015fkin d\u00fczenlemeler yer almaktad\u0131r. Bu maddelere g\u00f6re ev sahibi kiralad\u0131\u011f\u0131 evi kendisi, e\u015fi, altsoyu, \u00fcstsoyu ve yasal olarak bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu ki\u015filer i\u00e7in kullanmak isteyebilir. Ayr\u0131ca evin yeniden in\u015fas\u0131 ve imar amac\u0131yla esasl\u0131 onar\u0131m\u0131 s\u00f6z konusuysa yine ihtarname g\u00f6nderebilir.<\/p>\n\n\n\n<p>Belirli s\u00fcreye sahip olan s\u00f6zle\u015fmelerde s\u00f6zle\u015fme sonunda ve belirsiz s\u00fcreli s\u00f6zle\u015fmelerde ise genel h\u00fck\u00fcmlere g\u00f6re karar verilmektedir. Maddelerde ge\u00e7en \u201cihtiya\u00e7 duyma\u201d ve \u201cgereksinimler\u201d samimi bir \u015fekilde mahkemeye a\u00e7\u0131klanmal\u0131d\u0131r. Ev sahipleri kiraya verdikleri eve ihtiya\u00e7 duyabilirler.
