Kira \u00f6denmedi\u011finde bu durum kira s\u00f6zle\u015fmesin ayk\u0131r\u0131l\u0131k te\u015fkil eder. Bu durumda ev sahipleri kendi haklar\u0131n\u0131 kullanma \u00f6zg\u00fcrl\u00fc\u011f\u00fcne sahiptir.<\/p>\n\n\n\n<p><strong>Kira \u00f6denmezse tahliye s\u00fcreci <\/strong>ba\u015flatmak i\u00e7in hukuki yollara ba\u015fvurmak gerekir. Kirac\u0131n\u0131n hangi aylar kira \u00f6demedi\u011fi ya da eksik \u00f6dedi\u011fi tespit edilerek mahkemeye sunulur. Bundan \u00f6nce ev sahipleri kirac\u0131lara ihtar g\u00f6ndermektedir. \u0130htar hakk\u0131 nedirs orusu da bu durumda en s\u0131k sorulan sorular aras\u0131ndad\u0131r. S\u00f6zle\u015fme ihlali s\u00f6z konusuysa ve kirac\u0131 kiras\u0131n\u0131 \u00f6dememi\u015fse bu durumda ev sahibi kirac\u0131ya ihtar g\u00f6nderebilir. Bu ihtarla birlikte TBK\u2019da yer alan maddelere g\u00f6re kiran\u0131n \u00f6denmesini talep eder. \u0130ki hakl\u0131 ihtardan sonra kirac\u0131 kiray\u0131 \u00f6demezse bu sefer ev sahipleri tahliye davas\u0131 a\u00e7abilir.<\/p>\n\n\n\n<p><strong>Kira borcu tahliye \u015fart\u0131 <\/strong>aras\u0131nda yer al\u0131r. Kira \u00f6demeyen kirac\u0131n\u0131n temerr\u00fct sebebiyle tahliyesi i\u00e7in g\u00fcn\u00fc gelmi\u015f kira \u00f6denmemi\u015f olmal\u0131d\u0131r. Bu durumda ise ev sahipleri kirac\u0131ya yaz\u0131l\u0131 bir bildirim yani ihtarname g\u00f6nderir. Kiran\u0131n \u00f6demesi talep edilerek kirac\u0131ya belli bir s\u00fcre verilir. Kirac\u0131 kendisine verilen s\u00fcre i\u00e7inde kiray\u0131 \u00f6demedi\u011fi durumda ise ev sahibi bu duruma ba\u011fl\u0131 olarak kirac\u0131ya tahliye davas\u0131 a\u00e7abilir. Bu sayede kira \u00f6demeyen kirac\u0131 evden \u00e7\u0131kar\u0131lmaktad\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kirac\u0131 Tahliye \u015eartlar\u0131<\/h2>\n\n\n\n<p><strong>Kirac\u0131 tahliye \u015fartlar\u0131 <\/strong>hem ev sahipleri hem de kirac\u0131lar taraf\u0131ndan bilinmesi gereken \u015fartlard\u0131r. T\u00fcrk Bor\u00e7lar Kanunu madde 315\u2019te bu duruma ili\u015fkin d\u00fczenlemeler yer al\u0131r. Bu maddeye g\u00f6re kirac\u0131, kiralanan evi teslim ald\u0131ktan sonra sorumlu oldu\u011fu kira \u00fccretini ya da yan giderleri \u00f6demelidir. E\u011fer \u00f6denmezse ev sahipleri kirac\u0131ya yaz\u0131l\u0131 olarak bir s\u00fcre verir. Bu s\u00fcre i\u00e7inde de kiran\u0131n ya da di\u011fer bor\u00e7lar\u0131n \u00f6denmemesi durumunda s\u00f6zle\u015fme feshedilebilir. Kiray\u0131 geciktirme ya da \u00f6dememenin yan\u0131 s\u0131ra kira art\u0131\u015f\u0131na ra\u011fmen paray\u0131 eksik \u00f6deme gibi durumlarda ortaya \u00e7\u0131kar. Kirac\u0131 ve ev sahibi aras\u0131nda yap\u0131lan kira s\u00f6zle\u015fmesinde yer alan maddelerden birinin ya da daha fazlas\u0131n\u0131n ihlal edilmesi durumunda iki taraf da haklara sahiptir. E\u011fer kirac\u0131lar kiralar\u0131n\u0131 \u00f6demeyip s\u00f6zle\u015fmeyi ihlal ederlerse bu durumda ev sahipleri yasal haklar\u0131n\u0131 kullanmaktad\u0131rlar.<\/p>\n\n\n\n<p>Kiray\u0131 \u00f6dememekte \u0131srar eden kirac\u0131y\u0131 evden en h\u0131zl\u0131 \u015fekilde \u00e7\u0131karmak ad\u0131na kiran\u0131n \u00f6deme g\u00fcn\u00fcnde yat\u0131r\u0131lmamas\u0131yla birlikte hemen ihtarname g\u00f6nderilmelidir. \u0130htarname g\u00f6nderilene kadar kirac\u0131lar\u0131n kira bedelini \u00f6demesi durumunda tahliye edilemezler. Ayr\u0131ca dava s\u00fcrecinde kolay delil sunulmas\u0131 ad\u0131na ihtarname mutlaka noter arac\u0131l\u0131\u011f\u0131yla yap\u0131lmal\u0131d\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kira Borcu Nedeniyle Tahliye<\/h2>\n\n\n\n<p><strong>Kira borcu nedeniyle tahliye <\/strong>durumu, kiras\u0131n\u0131 zaman\u0131nda \u00f6demeyen ve \u00e7ekilen ihtarnameler ra\u011fmen \u00f6deme yapmayan kirac\u0131lar\u0131n kar\u015f\u0131la\u015ft\u0131\u011f\u0131 bir durumdur. Kiran\u0131n \u00f6denmemesiyle birlikte ev sahipleri hemen ihtar g\u00f6nderme hakk\u0131na sahiptir.<\/p>\n\n\n\n<p><strong>\u0130ki hakl\u0131 ihtar nedir<\/strong> sorusu da bu noktada \u00f6nem kazanmaktad\u0131r. Kirac\u0131 vaktinde kiray\u0131 \u00f6demezse ev sahipleri ihtarname haz\u0131rlayarak yaz\u0131l\u0131 olarak kirac\u0131ya g\u00f6nderirler. E\u011fer bir y\u0131lda iki kere kira i\u00e7in ihtarname g\u00f6nderilmi\u015fse bu durumda kirac\u0131 kira bedelini \u00f6dememi\u015fse, ev sahipleri tahliye davas\u0131 a\u00e7abilir.<\/p>\n\n\n\n<p>Bu durum T\u00fcrk Bor\u00e7lar Kan\u0131n\u0131 madde 352\u2019de ge\u00e7mektedir. Kirac\u0131 bir kira y\u0131l\u0131 ya da bu s\u00fcreyi a\u015fan zaman zarf\u0131nda kira bedelini \u00f6demedi\u011finden kendisine yaz\u0131l\u0131 olarak iki hakl\u0131 ihtar hakk\u0131na sahiptir. Kirac\u0131lar 30 g\u00fcn i\u00e7inde kiray\u0131 \u00f6demelidirler.
