Kira s\u00f6zle\u015fmelerinde art\u0131\u015f\u0131n \u00fcst s\u0131n\u0131r\u0131 T\u00fck Bor\u00e7lar Kanunu taraf\u0131ndan belirlenmektedir. \u00dcst kira s\u0131n\u0131r\u0131, T\u00fcketici Fiyat Endeksinde yer alan 12 ayl\u0131k ortalamayla birlikte yap\u0131lmaktad\u0131r. Yasal kira art\u0131\u015f\u0131, kira s\u00f6zle\u015fmelerinde belirlenen kira art\u0131\u015flar\u0131d\u0131r.<\/p>\n\n\n\n<p>Taraflar yap\u0131lacak olan kira art\u0131\u015flar\u0131n\u0131 s\u00f6zle\u015fmede belirlerler. Ve bu kira art\u0131\u015f\u0131na uyulmas\u0131 zorunludur. Ancak bu durum, kirac\u0131n\u0131n istedi\u011fi gibi zam yapabilece\u011fi anlam\u0131na da gelmemektedir. <strong>Kira art\u0131\u015f\u0131 zorunlu mu <\/strong>sorusunun cevab\u0131 hay\u0131rd\u0131r. \u0130ki taraf kira art\u0131\u015f\u0131 konusunda uzla\u015fmak ya da s\u00f6zle\u015fmeye yazmak zorunda de\u011fillerdir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kira Zam Hakk\u0131<\/h2>\n\n\n\n<p><strong>Kira zam hakk\u0131<\/strong> s\u00f6zle\u015fmede belirtilen maddelere g\u00f6re uygulanmaktad\u0131r. T\u00fcrk Bor\u00e7lar Kanunu\u2019na g\u00f6re taraflar\u0131n yenilenen kira d\u00f6nemlerinde uygulanacak olan kira \u00fccreti hakk\u0131ndaki anla\u015fmalar\u0131 bir \u00f6nceki kira y\u0131l\u0131nda t\u00fcketici fiyat endeksinde yer alan 12 ayl\u0131k ortalamalara g\u00f6re hesaplan\u0131p uygulanmaktad\u0131r.<\/p>\n\n\n\n<p>Kira art\u0131\u015f\u0131na uymayan kirac\u0131n\u0131n tahliyesi, kiraya veren taraf\u0131n hukuki yollara ba\u015fvurmas\u0131 ile ger\u00e7ekle\u015fmektedir. Bu durumda kiraya veren taraf icra yoluyla s\u00f6zle\u015fmeye uygun kira fark\u0131n\u0131 talep edebilir. Bu durumda iki taraf mahkemeye ba\u015fvurup kira bedelinin tespit edilmesini talep edebilmektedirler.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kira Zamm\u0131 Yap\u0131lmazsa Haklar<\/h2>\n\n\n\n<p><strong>Kira zamm\u0131 yap\u0131lmazsa haklar <\/strong>konusunda hem kirac\u0131lar hem de ev sahipleri ara\u015ft\u0131rma yapmaktad\u0131rlar. Kirac\u0131n\u0131n kira bedelini \u00f6demesi, kiraya veren taraflar aralar\u0131nda yap\u0131lan s\u00f6zle\u015fmeye g\u00f6re kirac\u0131n\u0131n asil y\u00fck\u00fcml\u00fcl\u00fckleri aras\u0131ndad\u0131r. Kirac\u0131lar kira bedelini ve e\u011fer mevcutsa di\u011fer giderleri \u00f6deme sorumlulu\u011funu \u00fcstlenmektedirler. Ayr\u0131ca s\u00f6zle\u015fmede yer alan vadelerdeki kira art\u0131\u015f\u0131na uymal\u0131d\u0131rlar. Ancak kira anla\u015fmas\u0131na uymayan kirac\u0131lar, yasal durumlarla kar\u015f\u0131 kar\u015f\u0131ya kalabilmektedirler.<\/p>\n\n\n\n<p>Kira art\u0131\u015f\u0131na uymayan kirac\u0131lar tahliye riskiyle kar\u015f\u0131la\u015fabilmektedirler. Yasal kira art\u0131\u015f\u0131na uymayan kirac\u0131lara \u00f6ncelikle ihtarname g\u00f6nderilmektedir. Bunun ard\u0131ndan da takip talep edilebilir. Hangi aya dair eksik \u00f6demenin ger\u00e7ekle\u015ftirildi\u011fi tespit edilip mahkemeye bildirilir. \u00dcstelik kirac\u0131ya eski \u00f6demeyi tamamlamas\u0131 ad\u0131n T\u00fcrk Bor\u00e7lar Kanunu\u2019nda yer alan s\u00fcre verilmelidir. Bu ihtarnameler de i\u015fe yaramazsa bu durumda kiraya veren taraf, s\u00f6zle\u015fmeye uymayan ve eksik kira \u00f6deyen kirac\u0131ya tahliye davas\u0131 a\u00e7abilmektedir.<\/p>\n\n\n\n<p><strong>Kira s\u00f6zle\u015fmesi art\u0131\u015f maddesi <\/strong>kar\u015f\u0131l\u0131kl\u0131 olarak s\u00f6zle\u015fmede belirtilmi\u015fse iki taraf da buna uymak zorundad\u0131r.
