G\u00fcn\u00fcm\u00fczde ev sahipleri ve kirac\u0131lar aras\u0131ndaki en yayg\u0131n sorunlar aras\u0131nda geciken ya da \u00f6denmemi\u015f kiralar yer al\u0131r. Kirac\u0131, yap\u0131lan s\u00f6zle\u015fme gere\u011fi kiray\u0131 zaman\u0131nda ve eksiksiz olarak \u00f6demelidir.<\/p>\n\n\n\n<p><strong>Kira \u00f6denmezse tahliye <\/strong>hakk\u0131na sahip olan ev sahipleri, olay\u0131n tahliye davas\u0131na varmamas\u0131 i\u00e7in kirac\u0131yla uzla\u015fabilir. Kira borcunun \u00f6denmemesi durumunda tahliyeden \u00f6nce yap\u0131labilecek ad\u0131mlar da vard\u0131r.<\/p>\n\n\n\n<p>Kira borcunun \u00f6denmemesi durumunda \u0130cra \u0130flas Kanunu\u2019nda yer alan madde 269\u2019a g\u00f6re kirac\u0131 aleyhine icra takibi ba\u015flatabilir. Bununla birlikte \u00f6denmeyen kira bedeli nedeniyle \u00f6deme emri g\u00f6nderilmektedir. <strong>Kira borcu tahsilat\u0131 <\/strong>i\u00e7in yap\u0131lan bu i\u015flemle kirac\u0131ya 30 g\u00fcn s\u00fcre verilir. Verilen s\u00fcre i\u00e7inde bor\u00e7 tam olarak \u00f6denmez ya da 7 g\u00fcnl\u00fck itiraz s\u00fcreci i\u00e7inde itiraz edilmezse \u0130cra Mahkemesi arac\u0131l\u0131\u011f\u0131yla tahliyedavas\u0131 a\u00e7\u0131l\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kirac\u0131 Kira \u00d6demezse<\/h2>\n\n\n\n<p><strong>Kirac\u0131 kiray\u0131 \u00f6demezse <\/strong>ev sahibi pek \u00e7ok yolla paray\u0131 tahsil edebilir ya da kirac\u0131y\u0131 evden \u00e7\u0131karabilir. Ev sahipleri Bor\u00e7lar Kanunu madde 315\u2019te yap\u0131lan d\u00fczenlemeyle, kirac\u0131 kira bedelini ya da yan giderleri \u00f6demezse noter arac\u0131l\u0131\u011f\u0131yla kirac\u0131ya ihtar g\u00f6nderebilmektedir. En az 30 g\u00fcn verilerek kira borcunun \u00f6denmesi talep edilir. Aksi durumda s\u00f6zle\u015fme feshedilerek ihtar verilir. Verilen s\u00fcrede kirac\u0131 bu borcu \u00f6demezse bu durumda tahliye talepli dava a\u00e7\u0131lmaktad\u0131r.<\/p>\n\n\n\n<p>Dava sonucunda al\u0131nan tahliye karar\u0131 icra dairesi arac\u0131l\u0131\u011f\u0131yla sonu\u00e7land\u0131r\u0131l\u0131r. Ayr\u0131ca T\u00fcrk Bor\u00e7lar Kanunu\u2019nda yer a\u015fan madde 362\u2019ye g\u00f6re kirac\u0131, kiralanan evin tesliminden sonra zaman\u0131 gelen kira bedelini \u00f6demezse ev sahibi kirac\u0131y\u0131 yaz\u0131l\u0131 olarak en az 60 g\u00fcnl\u00fck bir \u00f6nel verir. Bu \u00f6nel i\u00e7inde \u00f6deme yap\u0131lmazsa s\u00f6zle\u015fmenin feshedilece\u011fi belirtilmektedir. Verilen s\u00fcreye ra\u011fmen kira borcu \u00f6denmezse tahliye talepli dava a\u00e7\u0131lmaktad\u0131r. Burada yer alan maddeye g\u00f6re bir y\u0131ldan k\u0131sa s\u00fcren kira s\u00f6zle\u015fmelerinde bir kira d\u00f6nemi i\u00e7erisinde bir y\u0131ldan uzun s\u00fcreli kira s\u00f6zle\u015fmelerindeyse bir y\u0131l i\u00e7inde kiran\u0131n \u00f6denmemesi nedeniyle kirac\u0131ya ihtar g\u00f6nderilir. Kirac\u0131ya iki hakl\u0131 nedenlerle ihtar gitmi\u015fse kira s\u00fcresinin bitiminden sonraki bir ay i\u00e7inde ihtara gerek kalmadan tahliye davas\u0131 a\u00e7\u0131lmaktad\u0131r.<\/p>\n\n\n\n<p>Kirac\u0131 borcunu \u00f6demezse hakl\u0131 nedenlerden ihtar alabilmekte ve tahliye davas\u0131yla kar\u015f\u0131la\u015fabilmektedir. Bu nedenle zaman\u0131nda ve eksiksiz kira \u00f6demeye dikkat edilmesi gerekir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u0130cra Yoluyla Tahliye<\/h2>\n\n\n\n<p><strong>\u0130cra yoluyla tahliye <\/strong>genellikle kirac\u0131n\u0131n s\u00f6zle\u015fmeye ayk\u0131r\u0131 davrand\u0131\u011f\u0131 ve bunu telafi etmedi\u011fi durumlarda ortaya \u00e7\u0131kar. \u00d6denmemi\u015f kira ya da kira s\u00f6zle\u015fmesi dahilindeki gelir bor\u00e7lar\u0131 varsa bu durumda ilk olarak ihtar g\u00f6nderilir. Kirac\u0131lar bor\u00e7lar\u0131 \u00f6dememekte \u0131srar ederse bu durumda tahliye davas\u0131 a\u00e7\u0131labilir.<\/p>\n\n\n\n<p><strong>Kira borcu yasal s\u00fcre\u00e7 <\/strong>haline neden olursa hem kirac\u0131 hem de ev sahibi uzun bir s\u00fcre\u00e7le kar\u015f\u0131la\u015fabilmektedir. Ev sahibinin m\u00fclk\u00fc bo\u015faltmak i\u00e7in hakl\u0131 gerek\u00e7esi olmal\u0131d\u0131r. Bunlar aras\u0131nda konuta ihtiya\u00e7 duymas\u0131, kiras\u0131n\u0131n evi uygunsuz kullanmas\u0131 ya da kiray\u0131 \u00f6dememesi gibi durumlar yer almaktad\u0131r.<\/p>\n\n\n\n<p>Hem ev sahibi hem de kirac\u0131 i\u00e7in dava s\u00fcrecine girmek olduk\u00e7a y\u0131prat\u0131c\u0131 ve uzun s\u00fcreli olabilmektedir. Bu nedenle kirac\u0131n\u0131n kiray\u0131 \u00f6demedi\u011fi ya da \u00f6demedi\u011fi durumlarda ev sahibi ile anla\u015fmas\u0131 tavsiye edilir. Uzla\u015fmaya varmak iki taraf i\u00e7in de zaman kayb\u0131n\u0131 ve daha b\u00fcy\u00fck anla\u015fmazl\u0131klar\u0131 \u00f6nleyecektir.
