Kirac\u0131, eski kira s\u00f6zle\u015fmesiyle birlikte yeni ev sahibiyle olan ili\u015fkisini de koruma alt\u0131na almaktad\u0131r. Yeni ev sahibiyle tekrardan s\u00f6zle\u015fme yapmaya gerek duyulmaz. Yeni ev sahibinin hesap numaras\u0131 ve tapunun art\u0131k ondan oldu\u011funa ili\u015fkin belgeleri kirac\u0131ya iletmesi gerekmektedir.<\/p>\n\n\n\n<p>Kirada oturulan bir ev sat\u0131\u015fa \u00e7\u0131kar\u0131labilir. Ev sahipleri <strong>kirac\u0131l\u0131 ev sat\u0131\u015f\u0131 bildirimi <\/strong>yapmak durumundad\u0131r. Bu durumda kirac\u0131 ma\u011fdur edilmemektedir. Eski ev sahibiyle olan s\u00f6zle\u015fme, yeni ev sahibiyle de aynen devam eder. Kiral\u0131k bir evde kirac\u0131ysan\u0131z ve ev sahibi evi satmak istiyorsa T\u00fcrk Bor\u00e7lar Kanunu\u2019nda yer alan maddeler uygulanmaktad\u0131r. Kanunda belirtilenlere g\u00f6re eski ev sahibi evi sataca\u011f\u0131ndan dolay\u0131 kirac\u0131n\u0131n evden \u00e7\u0131kmas\u0131n\u0131 talep edememektedir. Yeni ev sahibi de kirac\u0131y\u0131 evden \u00e7\u0131karmak i\u00e7in gerekli nedenleri sunmal\u0131d\u0131r.<\/p>\n\n\n\n<p>Yeni ev sahibi ailesinin, alt ya da \u00fcst soyunun, bak\u0131ma muhta\u00e7 akrabas\u0131n\u0131 ya da kendisinin konut ihtiyac\u0131n\u0131 \u00f6ne s\u00fcrerek kirac\u0131n\u0131n evden tahliye edilmesini talep edebilir. Bu konut ihtiyac\u0131ndan do\u011fan oturma hakk\u0131n\u0131 kan\u0131tlamas\u0131 gerekmektedir. Bu durumda kirac\u0131ya belli bir s\u00fcre verilir ve bu s\u00fcre i\u00e7inde yasal s\u00fcrecin gerekliliklerine uyarak evden \u00e7\u0131kmas\u0131 istenir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ev Sat\u0131\u015f\u0131 Kirac\u0131ya Tebligat<\/h2>\n\n\n\n<p>Ev sat\u0131\u015f\u0131 kirac\u0131ya tebligat olarak iletilmelidir. Bu evi sat\u0131\u015fa koyan ev sahibinin sorumluluklar\u0131ndan biridir. Mevcut kira s\u00f6zle\u015fmesi, ev sahibi evi satsa bile yeni ev sahibiyle oldu\u011fu gibi devam etmektedir.<\/p>\n\n\n\n<p><strong>Yeni ev sahibi kirac\u0131 bildirimi <\/strong>yaparak yeni kirac\u0131n\u0131n kira \u00f6denecek hesab\u0131n\u0131n iban\u0131 mutlaka kirac\u0131lara iletilmelidir. Kirac\u0131n\u0131n ya\u015fam\u0131n\u0131 etkilemeyen bir s\u00fcre\u00e7tir. Bu sayede kirac\u0131 ma\u011fdur edilmemektedir. Evin sat\u0131laca\u011f\u0131 tarih 6 ay \u00f6ncesinden kirac\u0131ya ma\u011fduriyet \u00f6nleme a\u00e7\u0131s\u0131nda mutlaka bildirilmelidir. Kirac\u0131n\u0131n haklar\u0131 yasalar taraf\u0131ndan koruma alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Kirac\u0131 ve ev sahibi sorun ya\u015farsa s\u00f6zle\u015fmede yer alan maddeler sayesinde haklar\u0131n\u0131 arayabilirler.<\/p>\n\n\n\n<p>Ev sahibi hakl\u0131 bir neden bulunmuyorsa kirac\u0131y\u0131 s\u00f6zle\u015fme bitmeden evden \u00e7\u0131karamaz. Ayn\u0131 durum yeni ev sahibi i\u00e7in de ge\u00e7erlidir. Hakl\u0131 gerek\u00e7eler kanuna uygun \u015fekilde olmal\u0131 ve kan\u0131tlamal\u0131d\u0131r. TBK madde 301\u2019w g\u00f6re ev sahibi kira s\u00f6zle\u015fmesinin devam\u0131 s\u00fcresince m\u00fclk\u00fc nas\u0131l kiralad\u0131ysa o \u015fekilde tutmakla y\u00fck\u00fcml\u00fcd\u00fcr. Bu durumda evin tadilat masraflar\u0131 m\u00fclk sahibine aittir. Kirac\u0131lar ise m\u00fclkte yap\u0131lan ufak \u00e7apl\u0131 masraflar\u0131 kendi kar\u015f\u0131lar.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ev Sat\u0131ld\u0131ktan Sonra Kirac\u0131<\/h2>\n\n\n\n<p><strong>Ev sat\u0131ld\u0131ktan sonra kirac\u0131 ne yapar<\/strong> ya da evden \u00e7\u0131kar m\u0131 gibi sorular son derece s\u0131k sorulan sorulard\u0131r. EV sat\u0131ld\u0131ktan sonra kira s\u00f6zle\u015fmesi devam etti\u011fi m\u00fcddet\u00e7e kirac\u0131lar normal kira s\u00fcrecine devam edebilirler. Ancak evi sat\u0131n alan tyeni ev sahibi konut ihtiyac\u0131 dolay\u0131s\u0131yla kirac\u0131n\u0131n evden \u00e7\u0131kmas\u0131n\u0131 talep edebilir. Bu nedenle eski ev sahibi, evi satmadan 6 ay \u00f6nce bunu kirac\u0131s\u0131na bildirmelidir.<\/p>\n\n\n\n<p><strong>Kirac\u0131ya sat\u0131\u015f bildirimi s\u00fcresi <\/strong>6 ayd\u0131r. Ev sat\u0131lmadan 6 ay \u00f6nce bu durum mutlaka kirac\u0131ya bildirilmelidir. Kirac\u0131lar bu s\u00fcre i\u00e7inde her t\u00fcrl\u00fc ihtimale kar\u015f\u0131 \u00f6nlem alabilirler. Yeni ev sahibi konut ihtiyac\u0131yla eski kirac\u0131lar\u0131 evden \u00e7\u0131karma hakk\u0131na sahip olacakt\u0131r.<\/p>\n\n\n\n<p>Ev sat\u0131ld\u0131ktan sonra yeni ev sahibinin m\u00fclk\u00fcn sahipli\u011fine ili\u015fkin tapu belgesini ve kiran\u0131n yat\u0131r\u0131laca\u011f\u0131 iban numaras\u0131n\u0131 kirac\u0131lara g\u00f6ndermesi gerekir. B\u00f6ylece kirac\u0131n\u0131n s\u00f6zle\u015fme s\u00fcresi boyunca haklar\u0131 korunmaya devam edecektir. Kira s\u00f6zle\u015fmesinin bitiminde s\u00f6zle\u015fmenin yenilenip yenilenmeyece\u011fi ev sahibi ile kirac\u0131 ili\u015fkisine ba\u011fl\u0131d\u0131r.
