Ev sahipleri kirac\u0131lar\u0131 yaln\u0131zca belli \u015fartlar alt\u0131nda evden \u00e7\u0131karabilmektedir.<\/p>\n\n\n\n<p><strong>Kirac\u0131 tahliye \u015fartlar\u0131 <\/strong>aras\u0131nda en kesin olan durum kira s\u00f6zle\u015fmesinin dolmas\u0131d\u0131r. Ev sahibi bu durumda kirac\u0131y\u0131 evden \u00e7\u0131karabilmektedir. Ev sahibi mevcut s\u00f6zle\u015fmesinin sonlanmas\u0131ndan 15 g\u00fcn \u00f6nce kirac\u0131ya bildiride bulunmas\u0131 gerekmektedir. Bunu yapmazsa s\u00f6zle\u015fme ayn\u0131 \u015fekilde 1 y\u0131l daha uzat\u0131lmaktad\u0131r. Ev sahibinin de kirac\u0131n\u0131n da s\u00f6zle\u015fmeyi hala aktifken sonland\u0131rmas\u0131 i\u00e7in gerekli bir nedeni olmal\u0131d\u0131r.<\/p>\n\n\n\n<p>Belirsiz s\u00fcreli s\u00f6zle\u015fmelerde kirac\u0131 fesih bildirimiyle s\u00f6zle\u015fmeyi sonland\u0131rabilmektedir. Kirac\u0131n\u0131n borcunu \u00f6dememesi, aidat\u0131 kar\u015f\u0131lamamas\u0131, kurallara uymamas\u0131 gibi durumlarda tahliye edilmeleri i\u00e7in kan\u0131t toplanmal\u0131d\u0131r.<\/p>\n\n\n\n<p><strong>Yasal tahliye nedenleri <\/strong>kar\u015f\u0131land\u0131\u011f\u0131 m\u00fcddet\u00e7e tahliye davalar\u0131 da kolayl\u0131kla y\u00fcr\u00fcrl\u00fc\u011fe girmektedir. Kirac\u0131n\u0131n s\u00f6zle\u015fmedeki kurallara uymamas\u0131, ev sahipleri i\u00e7in \u00f6nemli kan\u0131tlar ta\u015f\u0131maktad\u0131r. Kirac\u0131lar\u0131n evden \u00e7\u0131kar\u0131lmas\u0131na neden olabilecek durumlardan baz\u0131lar\u0131 \u015funlard\u0131r:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Kiray\u0131 \u00f6dememek ya da devaml\u0131 geciktirmek<\/li>\n\n\n\n<li>Ev i\u00e7in gerekli yan masraflar\u0131 \u00f6dememek<\/li>\n\n\n\n<li>Evi hor kullanmak, bilerek zarar vermek<\/li>\n\n\n\n<li>S\u00f6zle\u015fmede yer alan maddelere uymamak<\/li>\n\n\n\n<li>Site ya da apartman kurallar\u0131na uymamak, aidat \u00f6dememek<\/li>\n\n\n\n<li>Ev sahibinden habersizce evin tamam\u0131n\u0131 ya da bir k\u0131sm\u0131n\u0131 ba\u015fkas\u0131na kiralamak<\/li>\n<\/ul>\n\n\n\n<p>Kirac\u0131n\u0131n apartman ya da site kurallar\u0131na uymamas\u0131, kira s\u00f6zle\u015fmesi ihlalleri aras\u0131nda yer al\u0131r. Ev sahipleri bu durumda kirac\u0131lara ihtarname g\u00f6ndererek 30 g\u00fcn s\u00fcre vererek fesih i\u015flemi ba\u015flatabilir. Ancak kirac\u0131 belirtilen s\u00fcre i\u00e7inde kira ya d ayan masraf \u00f6demeleri yapmazsa bu durumda ev sahibi, ikinci bir ihtar g\u00f6nderir. Kira s\u00f6zle\u015fmesi bitiminde kirac\u0131n\u0131n tahliyeye ili\u015fkin beyanda bulunmamas\u0131 ya da kira s\u00f6zle\u015fmesinin devam\u0131na ili\u015fkin bildirimde bulunmas\u0131 durumunda s\u00f6zle\u015fme ayn\u0131 ko\u015fullarda 1 y\u0131l daha devam etmektedir.<\/p>\n\n\n\n<p>T\u00fcrk Bor\u00e7lar Kanunu\u2019nda yer alanlara g\u00f6re kirac\u0131, s\u00f6zle\u015fme bitiminden en az 15 g\u00fcn \u00f6nce evi tahliye edece\u011fini kirac\u0131ya belirtmelidir. Bu durumda s\u00f6zle\u015fme sona erer. Ev sahibinin kural olarak s\u00f6zle\u015fme bitiminden \u00f6nce haber vermedi\u011fi durumlarda kirac\u0131n\u0131n evden \u00e7\u0131kmas\u0131n\u0131 isteme hakk\u0131 bulunmaz.<\/p>\n\n\n\n<p>Kirac\u0131n\u0131n kullan\u0131lan eve kendisinin, bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu birinin, alt ya da \u00fcstsoyunun ihtiya\u00e7 duymas\u0131 ve bunun kan\u0131tlanmas\u0131 halinde kirac\u0131y\u0131 evden \u00e7\u0131karabilmektedir. Bu nedenle kirac\u0131 tahliye edildi\u011finde ev sahipleri, 3 y\u0131l boyunca evi gereksinim nedeniyle kullanmak ya da kulland\u0131rmak zorundad\u0131r. Bu s\u00fcre i\u00e7inde bir ba\u015fkas\u0131na evi kiralayamaz. Art\u0131k eve ihtiya\u00e7 duyulmamas\u0131 halinde tekrardan kirac\u0131ya haber verilir. E\u011fer bu durum eski kirac\u0131ya bildirilmez ve ev ba\u015fkas\u0131na kiralan\u0131rsa ev sahipleri eski kirac\u0131s\u0131na en az son kira bedeli \u00fczerinden 1 y\u0131ll\u0131k kiray\u0131 tazminat olarak \u00f6demek zorunda kal\u0131r.<\/p>\n\n\n\n<p><strong>Ev sahibinin tahliye hakk\u0131 <\/strong>ihtiya\u00e7 sebebiyle, yeniden in\u015fa ve imar nedeniyle ya da ev sahibinin de\u011fi\u015fmesi nedeniyle ortaya \u00e7\u0131kar. Bunun yan\u0131 s\u0131ra kirac\u0131lar\u0131n neden oldu\u011fu zararlar nedeniyle de uyar\u0131da bulunulabilir.
