TBK\u2019da yer alan madde 347\u2019ye g\u00f6re, s\u00f6zle\u015fmede verilen s\u00fcrenin dolmas\u0131yla birlikte s\u00f6zle\u015fme ayn\u0131 ko\u015fullarla 1 sene daha uzam\u0131\u015f say\u0131lmaktad\u0131r.<\/p>\n\n\n\n<p><strong>Kira s\u00f6zle\u015fmesi bitince tahliye <\/strong>hemen ger\u00e7ekle\u015fmez. Ancak kirac\u0131 ve ev sahibi aras\u0131nda tahliye taahh\u00fctnamesi haz\u0131rlanm\u0131\u015fsa ya da ba\u015fka sebepler varsa bu durumda s\u00f6zle\u015fmesi biten kirac\u0131n\u0131n tahliye edilmesi sa\u011flan\u0131r.<\/p>\n\n\n\n<p><strong>Kontrat bitimi kirac\u0131 tahliyesi <\/strong>ev sahibinin tahliye imkan\u0131 olmasa dahi kirac\u0131 s\u00f6zle\u015fmeyi feshederek kendi r\u0131zas\u0131yla evden \u00e7\u0131kabilir. Bunun i\u00e7in kirac\u0131lar s\u00fcreleri dolmadan en az 15 g\u00fcn \u00f6nce ev sahibine evden \u00e7\u0131kacaklar\u0131n\u0131 bildirmelidir. Bildirmezse s\u00f6zle\u015fme her bitti\u011finde devaml\u0131 olarak 1 sene uzar.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ev Sahibi Kirac\u0131y\u0131 \u00c7\u0131karabilir Mi?<\/h2>\n\n\n\n<p>Kontrat bitiminde <strong>ev sahibi kirac\u0131y\u0131 \u00e7\u0131karabilir mi <\/strong>sorusunun cevab\u0131, s\u00f6zle\u015fmede belirtilmemi\u015fse ve kirac\u0131 15 g\u00fcn \u00f6ncesinden bildiride bulunmam\u0131\u015fsa, hay\u0131rd\u0131r. \u00d6rne\u011fin 5 y\u0131ll\u0131k kira s\u00f6zle\u015fmesi imzalanm\u0131\u015f ve bu 5 y\u0131l sonra kirac\u0131n\u0131n tahliye olaca\u011f\u0131 bilgisine yer verilmemi\u015fse, s\u00f6zle\u015fme bitiminde kira s\u00fcresi uzamaktad\u0131r. S\u00f6zle\u015fmenin s\u00fcresi dolmadan en az 15 g\u00fcn \u00f6nce kirac\u0131 evi bo\u015faltacaklar\u0131n\u0131 ev sahibine bildirmezse s\u00f6zle\u015fme yine uzar.<\/p>\n\n\n\n<p>1 y\u0131ll\u0131k kirac\u0131s\u0131n\u0131 tahliye etmek isteyen ev sahibi \u00f6ncelikle kanunda kendisine tan\u0131nan haklar\u0131 bilmek zorundad\u0131r. Somut delillerle hangi tahliye nedeninin meydana geldi\u011finin belirlenmesi ve buna g\u00f6re hukuki ad\u0131mlar at\u0131lmas\u0131 gerekmektedir. B\u00f6yle bir durumda alan\u0131nda uzman gayrimenkul avukat\u0131ndan yard\u0131m al\u0131nabilir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kira S\u00f6zle\u015fmesi Yenileme<\/h2>\n\n\n\n<p><strong>Kira s\u00f6zle\u015fmesi yenileme <\/strong>kirac\u0131 ve ev saibi aras\u0131nda s\u00f6zle\u015fmenin yenilenmesi anlam\u0131n\u0131 ta\u015f\u0131r. Kira s\u00f6zle\u015fmesindeki maddeler ve kira s\u00fcresi, yeni s\u00f6zle\u015fmeyle m\u00fcmk\u00fcn hale gelir. E\u011fer kirac\u0131, s\u00f6zle\u015fme bitiminden 15 g\u00fcn \u00f6nce konutu tahliye edece\u011fini ev sahibine bildirmezse ve konut sahibi tahliye taahh\u00fctnamesi haz\u0131rlamam\u0131\u015fsa s\u00f6zle\u015fme otomatik olarak yenilenir.<\/p>\n\n\n\n<p>Ev sahibinin kanunda yer ald\u0131\u011f\u0131 \u00fczere kendilerinin ya da yak\u0131nlar\u0131n\u0131n konut ihtiyac\u0131 do\u011fmu\u015fsa bu durumda kirac\u0131 tahliye edilebilmektedir. Kanuna g\u00f6re ev sahibinin kendisinin, altsoyundan birinin, e\u015finin ya da karde\u015flerinin konut ihtiyac\u0131 varsa bu durumda 1 y\u0131ll\u0131k kira s\u00f6zle\u015fmesi bitince kontrat yenilenmeden ev sahibi kirac\u0131y\u0131 \u00e7\u0131karabilmektedir.<\/p>\n\n\n\n<p>Bunun i\u00e7in kira s\u00f6zle\u015fmesinin sonunda kirac\u0131ya tahliye davas\u0131 a\u00e7\u0131l\u0131r. Fakat ihtiya\u00e7 durumunun do\u011fru bir \u015fekilde iletilmesi ve hukuki usullere uygun hareket edilmesi gereklidir. Konutta yap\u0131lacak b\u00fcy\u00fck tadilatlar nedeniyle ev bar\u0131n\u0131lamaz hale gelecekse bu durumda yine kirac\u0131n\u0131n tahliyesi sa\u011flanabilmektedir.<\/p>\n\n\n\n<p>Kirac\u0131 ve ev sahibi aras\u0131nda tahliye taahh\u00fctnamesi yap\u0131lm\u0131\u015fsa kira s\u00f6zle\u015fmesi bitti\u011finde s\u00f6zle\u015fme yenilenmeden kirac\u0131 evden \u00e7\u0131kar\u0131labilir. Bu durumda ise tahliye taahh\u00fctnamesinde yazan tarihle birlikte kirac\u0131n\u0131n evden \u00e7\u0131kmas\u0131 gerekir. Bu taahh\u00fctnameye ra\u011fmen iki taraf da kira s\u00fcresini uzatmak isterse buna g\u00f6re yenilikler ve s\u00f6zle\u015fme yenili\u011fi yap\u0131labilir.<\/p>\n\n\n\n<p>S\u00f6zle\u015fme bitiminde iki taraf da tahliye ile ilgili bir giri\u015fimde bulunmazsa s\u00f6zle\u015fme otomatik olarak yenilenip 1 y\u0131l daha uzad\u0131\u011f\u0131ndan tahliye i\u00e7in iki taraftan birinin durumu bildirmesi gerekir.<\/p>\n\n\n\n<p><a href=\"https:\/\/mulktakibi.com\/blog\/ev-sahibi-depozitoyu-ne-zaman-iade-etmek-zorunda\/\">Ev Sahibi Depozitoyu Ne Zaman \u0130ade Etmek Zorunda?<\/a><\/p>\n\n\n","protected":false},"excerpt":{"rendered":"<p>Kira kontratlar\u0131 kem kirac\u0131y\u0131 hem de ev sahibini g\u00fcvenceye alt\u0131na alan en \u00f6nemli unsurlardan biridir.
