Normal vatanda\u015flar kendi haklar\u0131n\u0131 bildiklerinde daha kolay ve bilin\u00e7li hareket ederler. \u00d6zellikle emlak ve hukuk alan\u0131nda i\u015fler yapacak olan insanlar bilgi toplamaya ve ona g\u00f6re hareket etmeye \u00e7al\u0131\u015f\u0131r.<\/p>\n\n\n\n<p>Emlak\u00e7\u0131lar ilk olarak gayrimenkul\u00fcn kiraya m\u0131 verilece\u011fi yoksa sat\u0131\u015fa m\u0131 verilece\u011fini belirten m\u00fc\u015fteriyle anla\u015f\u0131r. Malikler emlak kar\u015f\u0131l\u0131\u011f\u0131 komisyon bedelini \u00fcstlenmektedirler. <strong>Emlak\u00e7\u0131 komisyonu kirac\u0131 m\u0131 \u00f6der <\/strong>sorusunun cevab\u0131 evettir. Emlak\u00e7\u0131 gayrimenkul\u00fcn kiral\u0131k olundu\u011funu ilan etmekle sorumluyken kirac\u0131 ise emlak komisyonunu \u00f6demeyi \u00fcstlenir.<\/p>\n\n\n\n<p>Emlak\u00e7\u0131lar gayrimenkullerin sat\u0131l\u0131k veya kiral\u0131k oldu\u011funu ilan etmekte ve malikler komisyon bedelini \u00f6demektedirler. Emlak\u00e7\u0131n\u0131n al\u0131c\u0131dan emlak komisyonunu alabilmesi i\u00e7in baz\u0131 hukuki y\u00f6ntemler vard\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kiral\u0131k Ev Emlak Komisyonu<\/h2>\n\n\n\n<p>Emlak\u00e7\u0131lardan kiralanan evlerde <strong>kiral\u0131k ev evrak komisyonu <\/strong>sorunu s\u0131kl\u0131kla g\u00fcndeme gelmektedir. Kira s\u00f6zle\u015fmelerinde ya da sat\u0131m s\u00f6zle\u015fmelerinde emlak komisyon bedeninin kirac\u0131 ya da evi alacak ki\u015fi taraf\u0131ndan \u00f6denece\u011fi beyan edilir. Gayrimenkul sat\u0131\u015f s\u00f6zle\u015fmelerinde genellikle bu madde yer almaz.<\/p>\n\n\n\n<p>Kira s\u00f6zle\u015fmelerinde ise kirac\u0131n\u0131n emlak komisyonunu \u00f6demekle y\u00fck\u00fcml\u00fc oldu\u011fu belirtilmektedir. Bu y\u00fck\u00fcm Ta\u015f\u0131nmaz Yetkilendirme Y\u00f6netmeli\u011fi gere\u011fince d\u00fczenlenmi\u015ftir. Y\u00f6netmelik ile s\u0131n\u0131rlama getirildi\u011fi i\u00e7in bazen bu s\u0131n\u0131rlaman\u0131n ge\u00e7ersiz oldu\u011funa ili\u015fkin g\u00f6r\u00fc\u015fler ortaya at\u0131lmaktad\u0131r.<\/p>\n\n\n\n<p>Emlak komisyon s\u00f6zle\u015fmesinde t\u00fcm komisyon bedelinin al\u0131c\u0131 taraf\u0131ndan \u00f6denece\u011fi karar\u0131na var\u0131lm\u0131\u015fsa s\u0131n\u0131rlaman\u0131n y\u00fczde iki mi yoksa d\u00f6rt m\u00fc olaca\u011f\u0131 \u00fczerine baz\u0131 sorular mevcuttur. Fakat s\u0131n\u0131rlama yine y\u00fczde d\u00f6rtt\u00fcr. Ayr\u0131ca kiralanan m\u00fclk i\u00e7in emlak komisyonlar\u0131 da bir ayl\u0131k kira \u00fccretini ge\u00e7memektedir.<\/p>\n\n\n\n<p><strong>Emlak\u00e7\u0131 \u00fccret payla\u015f\u0131m\u0131 <\/strong>i\u00e7in gereken emlak komisyonu, emlak\u00e7\u0131lar\u0131n arac\u0131 oldu\u011fu al\u0131m sat\u0131m ya da kiralama i\u015flemlerinde \u00f6nem ta\u015f\u0131maktad\u0131r. Ayn\u0131 \u015fekilde kiralama i\u015flemlerinde de emlak\u00e7\u0131 komisyonu taraflar aras\u0131nda b\u00f6l\u00fc\u015ft\u00fcr\u00fclebilir.<\/p>\n\n\n\n<p>Emlak\u00e7\u0131larla yap\u0131lan sat\u0131\u015f ya da kira s\u00f6zle\u015fmelerinde mutlaka emlak\u00e7\u0131 komisyon s\u00f6zle\u015fmesi imzalanmas\u0131 \u00f6nerilir.
