T\u00fcrk Bor\u00e7lar Kanunu\u2019nda yer alan maddelerle s\u0131k\u0131 bir \u015fekilde d\u00fczenlenen kirac\u0131 ve ev sahibi haklar\u0131, s\u00f6zle\u015fmeyle somut hal almaktad\u0131r. Bu d\u00fczenlemeye g\u00f6re s\u00f6zle\u015fme s\u00fcresinden \u00f6nce hakl\u0131 bir sebep olmadan evin erken tahliye edilmesi durumunda borca ayk\u0131r\u0131l\u0131k durumu ortaya \u00e7\u0131kmaktad\u0131r.<\/p>\n\n\n\n<p><strong>Erken tahliye kirac\u0131 <\/strong>taraf\u0131ndan ger\u00e7ekle\u015ftirilecekse yasal h\u00fck\u00fcml\u00fcl\u00fcklerini yerine getirmesi gerekmektedir. Kira s\u00f6zle\u015fmesinin sona erme tarihi, s\u00f6zle\u015fmenin belirli bir s\u00fcre dahilinde haz\u0131rlan\u0131p haz\u0131rlanmamas\u0131na ba\u011fl\u0131d\u0131r. <strong>K<\/strong><strong>irac\u0131 erken \u00e7\u0131karsa ceza <\/strong>uygulamalar\u0131yla kar\u015f\u0131la\u015fmaktad\u0131r. Konut ve i\u015f yeri kiralama s\u00fcrelerinin bitiminden 15 g\u00fcn \u00f6nce, k\u0131ra verenlere tahliye bildirgesi yap\u0131lmal\u0131d\u0131r. E\u011fer yap\u0131lmazsa s\u00f6zle\u015fme bir y\u0131l daha uzamaktad\u0131r. Bu durumda kiraya veren ki\u015fi en fazla 10 y\u0131ll\u0131k kira uzatma s\u00fcreci sonunda kira s\u00f6zle\u015fmesini feshedebilmektedir.<\/p>\n\n\n\n<p>Belirsiz s\u00fcreli s\u00f6zle\u015fmelerde fesih bildirim s\u00fcrelerine uyulmal\u0131d\u0131r. S\u00fcreli s\u00f6zle\u015fmeler yap\u0131lacaksa konutun tahliye edilmesi i\u00e7in ev sahibi taraf\u0131ndan s\u00f6zle\u015fmeye tahliye taahh\u00fcd\u00fc eklenmelidir. E\u011fer taahh\u00fct yap\u0131lmam\u0131\u015fsa ve ev sahibi konutta oturma ihtiyac\u0131ndan dolay\u0131 kirac\u0131y\u0131 tahliye etmek isterse bu durumda T\u00fcrk Bor\u00e7lar Kanunu\u2019nda yer alan maddelere uyulmas\u0131 gerekmektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kirac\u0131 Erken \u00c7\u0131kma \u015eartlar\u0131<\/h2>\n\n\n\n<p><strong>Kirac\u0131 erken \u00e7\u0131kma \u015fartlar\u0131 <\/strong>yerine getirildi\u011fi durumda sorunsuz \u015fekilde evin tahliyesi ger\u00e7ekle\u015ftirilebilir. E\u011fer bulunmazsa s\u00f6zle\u015fme ayn\u0131 \u015fartlarla 1 y\u0131l daha uzam\u0131\u015f olur. Fakat uzatma s\u00fcresi 10 y\u0131l\u0131 bulursa kiraya veren ki\u015fi kiralayan ki\u015fiyi bir sebep g\u00f6stermeden evden \u00e7\u0131karma hakk\u0131na sahiptir.<\/p>\n\n\n\n<p>Belirli s\u00fcre zarf\u0131nda yap\u0131lan kira s\u00f6zle\u015fmeleri kirac\u0131n\u0131n s\u00fcrenin bitiminden en az 15 g\u00fcn \u00f6ncesinde bildirim yapmas\u0131yla sona ermektedir. E\u011fer bu bildiri yap\u0131lmazsa s\u00f6zle\u015fme 1 sene daha uzamaktad\u0131r. Yasaya g\u00f6re kirac\u0131, kira s\u00f6zle\u015fmesinde belirtilen s\u00fcre boyunca kiray\u0131 \u00f6demek ve evi kullanmakla sorumludur. Fakat hakl\u0131 nedenler mevcutsa bu durumda kira s\u00f6zle\u015fmesinin bitmesini beklemeden kiralanan konutu tahliye edebilir.<\/p>\n\n\n\n<p>T\u00fcrk Bor\u00e7lar Kanunu madde 331\u2019e g\u00f6re taraflardan her biri kira s\u00f6zle\u015fmesinin devam\u0131n\u0131 zor hale getiren anla\u015fmazl\u0131klar\u0131n varl\u0131\u011f\u0131 belirterek s\u00f6zle\u015fmeyi yasal olarak feshedebilirler. Kirac\u0131 ilgili kanun maddelerini gerek\u00e7e g\u00f6stererek kira s\u00f6zle\u015fmesini istedi\u011fi zaman feshedebilmektedir. Ancak hi\u00e7bir sorun olmadan feshetmek isterse <strong>kira tazminat\u0131 <\/strong>ve benzeri hukuki s\u00fcre\u00e7lerle kar\u015f\u0131la\u015fabilmektedir. Bu nedenle hukuki sorunlara haz\u0131rl\u0131kl\u0131ysa gerek\u00e7e g\u00f6stermeden \u00e7\u0131kmay\u0131 g\u00f6ze almal\u0131d\u0131r.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kira S\u00f6zle\u015fmesi Erken Fesih<\/h2>\n\n\n\n<p><strong>Kira s\u00f6zle\u015fmesi erken fesih <\/strong>durumunda TBK madde 325\u2019in maddeleri uygulan\u0131r. Kiralanan m\u00fclk\u00fcn kullan\u0131lmamas\u0131, TBK\u2019NIN genel h\u00fck\u00fcmlerinde d\u00fczenlenmektedir. 325. maddede kirac\u0131n\u0131n s\u00f6zle\u015fme s\u00fcresine ya da fesih zaman\u0131na uymadan kiralanan evden ayr\u0131lmas\u0131 durumunda kira s\u00f6zle\u015fmesinden do\u011fan bor\u00e7lar\u0131 s\u00f6zle\u015fme sonuna kadar devam eder.<\/p>\n\n\n\n<p>Kirac\u0131, evden \u00e7\u0131kma s\u00fcresi dolmadan \u00f6nce kiradan ayr\u0131lmak istiyorsa bunu ev sahibinin de kabul etmesi gerekir. E\u011fer etmezse s\u00f6zle\u015fmenin \u015fartlar\u0131n\u0131 ve kiray\u0131 kar\u015f\u0131layacak g\u00fcce sahip yeni bir kirac\u0131 bulunana kadar kira durumu devam eder. Yeni kirac\u0131 bulunursa kirac\u0131n\u0131n kira s\u00f6zle\u015fmesine dayal\u0131 borcu ortadan kalkar.<\/p>\n\n\n\n<p>Kirac\u0131lar evden erken ayr\u0131lmak istiyor ve evi kullanmayacak olmalar\u0131na ra\u011fmen kira bedelini s\u00f6zle\u015fme sonuna kadar yat\u0131rmak istemiyorsa bu durumda yeni bir kirac\u0131 bulabilir.
