Bunlardan biri de <strong>ev sahibi hangi masraflar\u0131 \u00f6der <\/strong>konusudur. Kiralanan evdeki masraflar\u0131n hangi tarafa ait oldu\u011fu, hem kirac\u0131n\u0131n hem de ev sahibinin haklar\u0131 konusunda bilgi eksikli\u011fi mevcuttur.<\/p>\n\n\n\n<p><strong>Kira masraflar\u0131 ev sahibi <\/strong>taraf\u0131ndan kar\u015f\u0131lanmasa da m\u00fclk i\u00e7indeki baz\u0131 masraflar ev sahibine ait zorunlu masraflard\u0131r. Kira s\u00f6zle\u015fmesine ili\u015fkin yasalar T\u00fcrk Bor\u00e7lar Kanunu\u2019nda belirtilmi\u015ftir. Ancak bu maddeler biraz karma\u015f\u0131k \u015fekilde i\u015flendi\u011finden, anlat\u0131lmak istenen net aktar\u0131lamamaktad\u0131r. Yan gider olarak da adland\u0131r\u0131lan masraflar, kira bedeli d\u0131\u015f\u0131nda kalan masraflar\u0131 tan\u0131mlamak i\u00e7in kullan\u0131lmaktad\u0131r.<\/p>\n\n\n\n<p>Ev kiralama ya da kiraya verme durumunda kira d\u0131\u015f\u0131nda baz\u0131 masraf t\u00fcrleri ortaya \u00e7\u0131kar. Bunlar:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L\u00fcks Masraf: L\u00fcks masraflar tamamen kullan\u0131ma g\u00f6re \u015fekillenen masraf t\u00fcr\u00fcd\u00fcr. \u00d6rnek vermek gerekirse duvar\u0131n rengini de\u011fi\u015ftirmek, d\u0131\u015f ya da ev i\u00e7indeki kap\u0131lar\u0131n daha l\u00fcks olanlarla de\u011fi\u015ftirilmesi, seramiklerin pahal\u0131 seramiklerle yenilenmesi gibi durumlar l\u00fcks masraf olarak ge\u00e7er.<\/li>\n\n\n\n<li>Faydal\u0131 Masraf: M\u00fclk i\u015finde ger\u00e7ekle\u015ftirilen masraflara faydal\u0131 masraf denir. Kullan\u0131m a\u00e7\u0131s\u0131ndan elzem olmayan masraflard\u0131r ve hayat kalitesine etki eden, zorunluluk olmayan masraf t\u00fcr\u00fcd\u00fcr.<\/li>\n\n\n\n<li>Zorunlu Masraf: Faydal\u0131 masraflar\u0131n aksine m\u00fclkiyetteki ya\u015fam\u0131n devam edebilmesi i\u00e7in kesinlikle yap\u0131lmas\u0131 gereken masraf t\u00fcr\u00fcd\u00fcr. \u00d6rne\u011fin m\u00fclk i\u00e7indeki tesisat\u0131n onar\u0131lmas\u0131, ar\u0131zalanan bir \u015feyin tamir edilmesi bu masraf t\u00fcr\u00fcne dahildir.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Ev Sahibinin Sorumlu Oldu\u011fu Masraflar<\/h2>\n\n\n\n<p><strong>Ev sahibinin sorumlu oldu\u011fu masraflar <\/strong>konusunda genellikle herkesin akl\u0131na gelebilecek baz\u0131 s\u0131n\u0131fland\u0131rmalar mevcuttur. Her m\u00fclk kullan\u0131m\u0131nda mutlaka m\u00fclk\u00fcn kullan\u0131lmas\u0131yla ilgili masraflar ve m\u00fclk\u00fcn var olmas\u0131yla ortaya \u00e7\u0131kan \u00f6demeler mevcuttur. <strong>Ev sahibi giderleri <\/strong>kirac\u0131n\u0131n kulland\u0131\u011f\u0131 m\u00fclk\u00fcn genel durumunu kar\u015f\u0131lamakla ortaya \u00e7\u0131kar. Ar\u0131zalanan tesisat ve ev kiralan\u0131rken i\u00e7inde olan di\u011fer e\u015fyalar\u0131n bak\u0131m\u0131ndan ev sahibi sorumludur. <strong>Demirba\u015f masraflar\u0131 ev sahibi <\/strong>taraf\u0131ndan kar\u015f\u0131lan\u0131r. Bu masraflar m\u00fclk\u00fcn orada var olmas\u0131ndan kaynakland\u0131\u011f\u0131 i\u00e7in ev sahipleri bu masraflar\u0131 kar\u015f\u0131lamakla y\u00fck\u00fcml\u00fcd\u00fcrler. Kullan\u0131ma ba\u011fl\u0131 olarak meydana gelen masraflar da s\u00f6z konusudur. Mesela evde su kullan\u0131lmazsa suyla ilgili masraf da ortaya \u00e7\u0131kmaz. Fakat s\u00f6z konusu m\u00fclkte su kullan\u0131ld\u0131\u011f\u0131ndan bu do\u011frultuda da baz\u0131 masraflar ortaya \u00e7\u0131kabilir.<\/p>\n\n\n\n<p>Kanunda yer alan yasal d\u00fczenlemelere bak\u0131ld\u0131\u011f\u0131nda masraf konusunda temel farkl\u0131l\u0131klar vard\u0131r. Ayr\u0131ca kiralanan yerin hasarl\u0131 bir konuma d\u00fc\u015fmesi durumunda ortaya \u00e7\u0131kan masraflar da farkl\u0131l\u0131klara sahiptir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ev Sahibi Giderleri Nelerdir?<\/h2>\n\n\n\n<p><strong>Ev sahibi giderleri <\/strong>yan masraflar olarak da adland\u0131r\u0131lan masraf t\u00fcr\u00fcne girer. Kiralanan mal varl\u0131\u011f\u0131n\u0131n zorunlu deprem sigortas\u0131 ve emlak vergisi gibi kamusal s\u0131n\u0131fa ait giderleri vard\u0131r. Bu giderler kiraya veren ki\u015fi taraf\u0131ndan kar\u015f\u0131lanmaktad\u0131r. Ancak taraflar kira s\u00f6zle\u015fmesiyle birlikte bu masraflar\u0131n kim taraf\u0131ndan \u00f6denece\u011fini de\u011fi\u015ftirebilirler.<\/p>\n\n\n\n<p>TBK\u2019da yer a\u015fan madde 303\u2019e g\u00f6re m\u00fclk\u00fc kiraya veren ki\u015fi, kirac\u0131n\u0131n kullan\u0131m\u0131yla alakal\u0131 olacak \u015fekilde kendisi ya da \u00fc\u00e7\u00fcnc\u00fc ki\u015fi taraf\u0131ndan ger\u00e7ekle\u015ftirilen yan giderleri kar\u015f\u0131lamakla y\u00fck\u00fcml\u00fcd\u00fcr. Bu yan gelirler d\u0131\u015f s\u0131va onar\u0131m\u0131, \u00e7at\u0131 onar\u0131m\u0131, park yeri d\u00fczenlemesi ve bah\u00e7e d\u00fczenlemesi gibi giderleri kapsamaktad\u0131r.<\/p>\n\n\n\n<p>Kirac\u0131lar, TBK\u2019da yer alan madde 314\u2019e g\u00f6re kira bedelini ve gerekliyse yan giderleri ay\u0131n sonunda ve kira s\u00fcresinin bitimi esnas\u0131nda \u00f6demekle y\u00fck\u00fcml\u00fc k\u0131l\u0131n\u0131r. Bu sayede iki taraf yan giderleri kapsan bir kira s\u00f6zle\u015fmesi yapabilmektedir. <strong>E<\/strong><strong>v sahibi bak\u0131m onar\u0131m <\/strong>gibi masraflar\u0131 kar\u015f\u0131l\u0131kl\u0131 s\u00f6zle\u015fme yoluyla kirac\u0131ya aktarabilmektedir.<\/p>\n\n\n\n<p>TBK\u2019da yer alan madde 317\u2019ye g\u00f6reyse kirac\u0131 kiralad\u0131\u011f\u0131 evin kullan\u0131m\u0131 i\u00e7in gerekli bak\u0131m ve temizlik giderlerini \u00f6demelidir. Bunlar temizlik bedeli, elektrik, do\u011falgaz ve su gibi giderlerdir. E\u011fer s\u00f6zle\u015fmeyle belirtilmediyse kiralanan yer sonradan hasarl\u0131 hale gelirse ve ba\u015fka giderler ortaya \u00e7\u0131karsa (\u00e7at\u0131n\u0131n akmas\u0131 ya da muslu\u011fun bozulmas\u0131 gibi) bu durumda kirac\u0131 bunlar\u0131n kar\u015f\u0131lanmas\u0131n\u0131 isteyebilir.
