Baz\u0131 durumlarda ev sahipleri b\u00fct\u00fcn masraflar\u0131 kirac\u0131lar\u0131n y\u00fcklenmesini s\u00f6ylerken bazense ev sahiplerinin evin yap\u0131sal ihtiya\u00e7lar\u0131n\u0131 gidermesi gerekti\u011fi s\u00f6ylenir. <strong>Kirac\u0131 aidat\u0131 \u00f6der mi <\/strong>sorusu da bu tart\u0131\u015fma konular\u0131ndan biridir.&nbsp;<\/p>\n\n\n\n<p>Kat M\u00fclkiyeti Kanunu\u2019nda yer alan madde 20\u2019ye g\u00f6re kat malikleri, ya\u015fad\u0131klar\u0131 binan\u0131n ortak alanlar\u0131n\u0131n bak\u0131m\u0131ndan, korunmas\u0131ndan ve temizli\u011finden sorumlu tutulur. Tamir i\u00e7in yap\u0131lan giderlere katk\u0131da bulunmalar\u0131 beklenir. Bunlar i\u00e7in kat maliklerine \u00f6denen \u00fccrete aidat ad\u0131 verilir.&nbsp;<\/p>\n\n\n\n<p>Aidat olarak toplanan \u00fccretlerle bak\u0131m, onar\u0131m, ortak elektrik, do\u011falgaz, g\u00fcvenlik, kap\u0131c\u0131, y\u00f6netim giderleri gibi pek \u00e7ok alanda \u00f6deme yap\u0131lmaktad\u0131r. Bu masraflar aras\u0131nda bina sigortas\u0131 gibi \u00f6denekler de yer almaktad\u0131r.&nbsp;<\/p>\n\n\n\n<p>Kat M\u00fclkiyeti Kanunu\u2019nda yer alan maddeye g\u00f6re binan\u0131n g\u00fcvenli\u011fi, temizli\u011fi ve di\u011fer ihtiya\u00e7lar\u0131 ve y\u00f6netim paras\u0131 ev sahipleri taraf\u0131ndan kar\u015f\u0131lanmal\u0131d\u0131r. Bu nedenle site ya da bina y\u00f6netimince talep edilen aidat miktar\u0131 do\u011frudan mal sahibini ilgilendirir. Kirac\u0131 aidat \u00f6demeyi \u00fcstlense dahi yasal sorumluluk her zaman ev sahibine aittir. E\u011fer kirac\u0131 aidat \u00f6demelerini ger\u00e7ekle\u015ftirmemi\u015fse hukuki muhatap ev sahibi olur.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Apartman Aidat\u0131 Kirac\u0131 Sorumlulu\u011fu Mu?<\/h2>\n\n\n\n<p><strong>Apartman aidat\u0131 kirac\u0131 sorumlulu\u011fu <\/strong>mu sorusunun cevab\u0131 hukuken hay\u0131rd\u0131r. Aidat \u00f6deme sorumlulu\u011funun kirac\u0131da olmas\u0131, kirac\u0131 ve ev sahibi aras\u0131nda yap\u0131lan anla\u015fmaya ba\u011fl\u0131d\u0131r. E\u011fer yap\u0131lan kira s\u00f6zle\u015fmesinde kirac\u0131n\u0131n aidat \u00f6deme konusunda sorumlu olmas\u0131 ile ilgili bir madde yer al\u0131yorsa bu durumda kirac\u0131 aidat \u00f6demek zorundad\u0131r. Malikin gecikme faizi ve di\u011fer yapt\u0131r\u0131mlarla kar\u015f\u0131la\u015fmamas\u0131 ad\u0131na ilk olarak aidat borcunu \u00f6demesi gerekmektedir. \u00d6deme yap\u0131ld\u0131ktan sonra hak sahibi olan ki\u015fi kirac\u0131ya kar\u015f\u0131 hukuki s\u00fcre\u00e7 ba\u015flatma hakk\u0131na sahiptir. Kirac\u0131n\u0131n aidat \u00f6deme sorumlulu\u011funu yerine getirmemesi Bor\u00e7lar Kanunu\u2019na g\u00f6re s\u00f6zle\u015fmeye ayk\u0131r\u0131 davranmak anlam\u0131na gelir. Mal sahibi de hakl\u0131 nedenlerden dolay\u0131 olay\u0131 mahkemeye ta\u015f\u0131ma hakk\u0131nda sahiptir.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ev Sahibi Aidat\u0131 \u00d6demezse Ne Olur<\/h2>\n\n\n\n<p><strong>Ev sahibi aidat\u0131 \u00f6demezse ne olur<\/strong> sorusunun cevab\u0131 hukuki s\u00fcre\u00e7tir. S\u00f6zle\u015fme gere\u011fi kirac\u0131n\u0131n \u00f6demesi gereken aidat nedeniyle ev sahibi hakk\u0131nda icra takibi ba\u015flat\u0131labilir. Site aidat\u0131 kirac\u0131 taraf\u0131ndan \u00f6denmemi\u015fse, t\u00fcm yasal sorumluluk ev sahibine aittir. E\u011fer kira s\u00f6zle\u015fmesinde kirac\u0131n\u0131n aidat \u00f6demesine ili\u015fkin bir yaz\u0131 belirtilmemi\u015fse bu durumda aidat borcundan dolay\u0131 ev sahibi kirac\u0131ya dava a\u00e7amaz<\/p>\n\n\n\n<p><strong>Kira ve aidat sorumlulu\u011fu <\/strong>kira s\u00f6zle\u015fmesiyle birlikte birbirinden ayr\u0131lmal\u0131d\u0131r. Aidat borcunun \u00f6denmeme durumu devam ederse apartman y\u00f6netimi yasal takip ba\u015flatma hakk\u0131na sahiptir.
