S\u00fcrekli olarak de\u011fi\u015fmekte olan ekonomik ko\u015fullar, yetersiz denetim mekanizmalar\u0131 ve artan kira fiyatlar\u0131 mevcut sorunlar\u0131 daha da \u00e7\u00f6z\u00fclemeyen hale getirmektedir. G\u00fcn\u00fcm\u00fczde konut kiralama ili\u015fkileri bir\u00e7ok problemi i\u00e7erisinde bar\u0131nd\u0131rmaktad\u0131r.<\/p>\n\n\n\n<p>B\u00fcy\u00fck \u015fehirlerde uygun bir ev bulmak daha da zor hale gelmektedir kirac\u0131 ve ev sahipleri aras\u0131nda ya\u015fanan anla\u015fmazl\u0131klar\u0131n g\u00fcn ge\u00e7tik\u00e7e art\u0131\u015f g\u00f6stermesi ile bu konu yaln\u0131zca \u00f6zel hukuk meselesi i\u00e7erisinde de\u011ferlendirilmemektedir. Ek olarak toplumsal huzuru da tehdit etmekte olan boyuta ula\u015fmaktad\u0131r. Ev sahibi ile kirac\u0131 aras\u0131nda en \u00e7ok kar\u015f\u0131la\u015f\u0131lan yayg\u0131n problemler \u015fu \u015fekildedir:<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1- Depozito \u0130adelerine Ba\u011fl\u0131 Haks\u0131z Kesintiler<\/h2>\n\n\n\n<p>Kirac\u0131lar evden \u00e7\u0131kmak istediklerinde s\u0131kl\u0131kla depozitonun ya hi\u00e7 verilmemesi veya haks\u0131z yere kesilerek iade edilmesi gibi durumlarla kar\u015f\u0131la\u015fmaktad\u0131rlar. Yasalara g\u00f6re depozito, kiralanan evde yarat\u0131lan zarar d\u0131\u015f\u0131nda geri \u00f6denmesi gerekmektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2- Fahi\u015f Kira Art\u0131\u015f Talebi<\/h2>\n\n\n\n<p>G\u00fcn\u00fcm\u00fczde kirac\u0131 ve el sahipleri aras\u0131nda en \u00e7ok kar\u015f\u0131la\u015f\u0131lan sorunlardan biri de annemin y\u0131l d\u00f6n\u00fcm\u00fcne giderken ev sahiplerinin m\u00fclke kar\u015f\u0131 kira art\u0131\u015f talebidir. B\u00fcy\u00fck \u015fehirlerde olan ev sahipleri piyasadaki mevcut kira bedellerine g\u00f6re art\u0131\u015f istemektedir.<\/p>\n\n\n\n<p>Kanunlara g\u00f6re kira art\u0131\u015f oran\u0131 y\u0131ll\u0131k t\u00fcketici fiyat endeksi oran\u0131n\u0131 ge\u00e7meyecek \u015fekilde ayarlanmal\u0131d\u0131r. Dolay\u0131s\u0131yla birden fazla nedene ba\u011fl\u0131 olarak tahliye bask\u0131s\u0131yla kar\u015f\u0131la\u015fabilmektedir.<\/p>\n\n\n\n<p>Ancak belirtilen gerek\u00e7eler yasalar gere\u011fince tahliye i\u00e7in yeterli olmayabilir. Fakat bir\u00e7ok kirac\u0131 yasal haklar\u0131 yeterince bilmemekte veya mahkeme s\u00fcrecini girmek istememektedir.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4- Kirac\u0131n\u0131n Oturdu\u011fu Evin Sat\u0131ld\u0131\u011f\u0131 Durumlarda Mevcut Haklar\u0131<\/h2>\n\n\n\n<p>Kiralanm\u0131\u015f olan evin sat\u0131ld\u0131\u011f\u0131 durumlarda kirac\u0131lar sorunlarla kar\u015f\u0131la\u015fabilir. Ev sahibi evi satt\u0131\u011f\u0131 durumlarda yeni malik kirac\u0131y\u0131 hemen \u00e7\u0131kartamamaktad\u0131r. Yasalarda belirtilen detaylara g\u00f6re tahliye davas\u0131 a\u00e7abilir veya 6 ay i\u00e7inde yaz\u0131l\u0131 ihtar \u00e7ekebilmektedir.<\/p>\n\n\n\n<p>Ev sahipleri baz\u0131 durumlarda bu s\u00fcrece uymaks\u0131z\u0131n kirac\u0131y\u0131 bask\u0131 y\u00f6ntemiyle \u00e7\u0131kartmak isteyebilir. Kirac\u0131lar\u0131n kendi haklar\u0131n\u0131 iyi tan\u0131mas\u0131, haks\u0131z tahliyelerin \u00f6n\u00fcne ge\u00e7ebilir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ev Sahibi \u0130le Kirac\u0131 Aras\u0131nda Ya\u015fanan Sorunlar Nas\u0131l \u00c7\u00f6z\u00fcl\u00fcr?<\/h3>\n\n\n\n<p>Ev sahibi ve kirac\u0131 aras\u0131nda g\u00f6r\u00fclmekte olan sorunlar\u0131n \u00e7\u00f6z\u00fcm\u00fc olduk\u00e7a basittir.
